may pinsan kac ako plano din nya mag submit ng application bago matapos ang october pero semilar din yong case nila sa inyo. yong pinsan ko yong sponsor.
nag kakilala sila nung asawa nya way back nung highschool at college sila parehas sila ng school nung time na yon medyo nanliligaw na sa kanya yong lalaki
pero sa kasamaang palad yong bestfriend nung naging asawana ang naging boyfriend nya nung panahon na yon pero nag break then. nasa college yong pinsan ko nun nung mag immigrate from that time wala na silang commnucation until after 6 years nag bakasyon itong pinsan ko sa pinas di inaasang nag kita sila nung lalaki noon april 6, 2016 so from that day everyday lagi silang magkasama at naging sila na rin then on may 13, 2016 two days before bumalik ang pinsan ko sa canada nag pakasal sila and later on nalaman ng pinsan ko na buntis na rin cya.

so malamang mas red flag itong sa kanya kasi wala naman silang communication for 6 years tapos bigla ngkita at naging sila for 38 days tapos nag pakasal na heheh.. sabi ko nga bat ng pakasal agad e nag mamahalan daw sila.

Would still suggest you wait na lang muna if it is really needed. I see that you already got your AOR2. If a new NBI is really needed, then probably prior to PPR, you may still be asked to get a new one. But I still think you won't be asked anymore.

Yes, that is ok kase may times na "sawa" na kami magtype and more on voice/video calls na.

Totoo din po na it is not the quantity but the quality of the documents. Yung chat po namin since 2014, ang ginawa ko po one screenshot lang every 2-3months period. Meron nga akong nabasa dati dito sa forum na nakalagay sa GCMS notes nya na inignore na ang ibang proofs sa sobrang dami. Sa picture naman po, konti lang ang selfie kasi mas importante sa kanila na ibat ibang lugar, occassion, at may ibang taong kasama. Luckily, mahilig talaga kami sa family pictures.

Lahat po ng tips nabasa ko din lang sa forum na ito. Goodluck to all.

yes, trinanslate ko talaga lahat in english. Yung mga mahirap itranslate like shortcut txt/chat messages, inexplain ko pa. We always say "amishooo!" so inexplain ko na it's our own way of saying "I miss you.". Ginawa ko pong very detailed talaga and it was all worth it.

Sa photos, categorize ko sya by events/date with captions (sino kasama, saan naganap, and others)

Sa social media post, FB then divided into three categories by his account, my account, and other people's account. Next is IG, two categories din, his account and my account. Ang kinuha ko po ay ang mga post na magpapatunay about sa relationship namin. Trinanslate ko in english lahat ng tagalog.

Sa communications, arrange by date divided into two categories - (1) video/voice call screenshots (2) chat conversations from iMessage, FB Messenger, Skype, Whatsapp, and regular text. Trinanslate ko in english lahat ng tagalog.


Sa other documents, joint bank account, dhl document nung pinadalhan ko sya ng gift, handwritten letters, and others. Trinanslate ko in english lahat ng tagalog.

Did you also send an AOM? Personally speaking, you don't really need an immigration lawyer. Since you were asked to send a written explanation about Article 34, then write one and explain that you were granted for that type of wedding because it is in the Philippines' Family Code. Just state that:

On July 6, 1987, Executive Order No. 209, The Philippines Family Code, signed by the late President Corazon C. Aquino, Article 34 stated that: No license shall be necessary for the marriage of a man and a woman who have lived together as husband and wife for at least five years and without any legal impediment to marry each other. The contracting parties shall state the foregoing facts in an affidavit before any person authorized by law to administer oaths. The solemnizing officer shall also state under oath that he ascertained the qualifications of the contracting parties are found no legal impediment to the marriage. (76a)

You may also add and request 2 of your dear friends to execute an Affidavit attesting that they have known you since ? and thereby confirming that you and your spouse have been living together for ? prior to your marriage on ?.

Start writing the letter now and have 2 of your friends execute an Affidavit on Monday or next week. Since you do not have much time left, send a note back to CIC or CEM and ask for an extension. Least they know that you are indeed working on their request.

Kailangan din nila patunayan na continuing ang rel nila, tell them to save their convo. :)

Naniniwala po ang CEM na legal silang kinasal. Ang question ng CEM is nag live in ba sila (yan ang reqt para maikasal under Article 34) for several years? If nag live in sila at hindi sya naideclare as common law, that is misrepresentation. Kung hindi sila nag live in, CEM might not consider the marriage kase technically nagsinungaling sila.

So mahirap po ang sitwasyon nila kase yes or no man ang sagot nila, same problem, may mali sa application.

Yes, this is how I understand it as well.

Unfortunately, this is a tough situation and mag be based ang CEM ng decision based sa reply nila sa letter. Kaya strongly recommended to seek for legal advice. Anuman ang sagot nila, yes or no, may mali sa nangyari.

This is what I got from NBI site...

One of several phrases can appear in the remarks section of a NBI Police Clearance Certificate. “No record on file” is noted when the individual has never obtained a Certificate; “No derogatory record” is indicated on Certificate renewals;

...If an applicant’s certificate indicates “No record on file, or “No derogatory record,” an official letter from the NBI is not required...

Well, probably NBI system has changed since April of 2015, and I got "no record on file", is because I was included in their old system, and the last NBI I requested way back 2007 . Now it's clear. Hope this may also help those confused like me. haha. Thanks and good luck to all us! :D :D :D

If you confirm that you have been living together prior to marriage, when he became a PR, dineclare ka ba nya as COMMON LAW? Bakit hindi ka nya dineclare? Ang ka-live in po dito sa Canada ay dinedeclare as common law.

You know, this is just my personal and non-expert opinion, you can get proofs na nag live in nga kayo and just tell them na hindi ka nya dineclare kasi you are having issues that time na naging PR sya. Hindi nyo alam mangyayari sa relasyon nyo. Again, it is just a non-expert opinion.

I think gusto na lang nila palabasin na naglive-in nga sila (even hindi totoo) kase medyo may chance sila sa sagot na yun. Pag ang sagot nila is "hindi sila nag live in", most likely, walang bisa ang kasal sa pananaw ng CEM.

heykheysei, my advice to you, if you plan to make up story, just make sure na hindi kayo mahuhuli. Otherwise, mas magiging magulo ang magulo ng sitwasyon. Isipin nyo na lang kung saan mas magiging light ang decision ng CEM. FYI, misrepresentation has a ban of 2-5 years yata.
