We got married couple of weeks ago. My husband is a Canadian divorcee. We got married as per the Muslim rites and law and have only a nikah nama and marriage certificate signed and issued by the priest who conducted and presided over our nikah . We took this to the marriage officer at the local BMC office. They refuse to register the nikah nama stating that they cannot register a marriage with a foreign national divorcee and asked us to go to the family court in Bandra. They are saying that they do not accept the Divorce decree and Divorce Order copies from Canada as these are only one page and are asking us to file for his divorce decree in the Indian court. (Tell me this is a joke). He's never lived here, nor has his ex-wife. He's divorced for a decade. How can they file for a divorce here in India, AGAIN?!?

I'm so totally confused running from one office to another and don't know where to make a start from. It feels like I'm banging my head against a wall.

My questions are
1. how can I get the nikahmana registered? He has left for Canada. I'm here and need to get these documents organised.
2. Can and will the nikah nama and marriage certificate issued by the presiding priest and institution suffice as proofs of marriage? Should I get these notarised or some thing else to make them look as more solid proofs? (so confused and frustrated already!). We have plenty of other evidences, eg wedding card, photos, nikah photos, nikahnama signing photos, all ceremonies photos, bills and invoices of skype calls, hotels, whatsapps texts, phone messages etc.

PLEASE HELP, PLEASE!!!

Totally crazy of them that they cannot register.

I cant talk about a Canadian national registering the marriage. But I am a PR and went to India to get married, we performed a nikah and took the certificate from the priest went to the registration office, filled the form (had to submit - wedding card, priest certificate notraized and took the orginal, copy of bills and for some reason a letter from the hotel saying the marriage was conducted there) and that was it. YES we had to grease the wheels a little to it gets done faster but it was done.

Once it was ready we both had to go and proof read and sign.

We did it in Chennai

Hopefully the one month increase the NVDO shouldnt have much impact on the avg which seems to be about 6-7 months.

Unfortunately the 90 days is going to be a wait, hang in there and there nothing else to do now

GUYS. I have a question . I HEARD FROM FEW PEOPLE (WHICH I WONT BELIEVE) We can apply Visitor Visa for spouse once we get file number from CIC..

Hello guys,

I just returned to canada after my marriage, my wife is in India. So, if i have to sponsor her for PR, do i have to fill sponsors application and send to where??
I mean, --just fill sponsorship(my part) application send to office in Canada for approval and then send to new delhi by myself or by processing office?? or Fill sponsorship application with the necessary documents attached, send it to my wife directly and then she will have to apply together to new delhi office?? I still didn't get how it work...

Please clarify...

Many thanks in advance

Arun

Hi there
I got married in November 2014. I'm working here in India as a teacher since last 4 years. My husband went back to Alberta where he is working taking along the court marriage and other required docs. He has hired a lawyer in Calgary. He sent me few spouse visa papers that i signed and couriered them back to him. I want to start living with my husband soon. Please enlighten me with the spouse visa procedure. Also will he be approved on sponsoring me?
What are the do's and dont's for the procedure.

Note- My husband is on work permit. No PR yet.

Any help is appreciated.

Thanks a lot.

There are two set of forms, one for sponsorship approval, which you have to fill out and the other is the sponsored spouse (principal applicant) forms, which you wife will have to fill out (you can help her fill out the forms). Both set of forms will require additional supporting documents as per the checklist.

You (sponsor) will have to compile the entire package and send it to CPC- Mississauga, where they would check the completeness of your documents and approve your sponsorship for your wife. Than the entire package will be transferred to New Delhi by CPC- Mississauga, where they will check the authenticity of your relationship and the background checks of your wife.

This is definitely a better and detailed explanation :D

If he is on work permit then you will have to apply for open work permit. Which I think has to be applied in India if you live there.

Many Thanks for clarifying simply :) I went through checklist and forms, i feel like i can do it, coz i did my PR application myself with help of the great people in this forum. I am so thankful for this forum.
I just have few more doubts before i start filling application,

1- I don't see anywhere it says exactly like how much am i suppose to earn yearly to support just my wife? but it says like necessary minimum income, by the way, what and how much was that? (In my case, my annual income of last year would be around $30,000 and getting more this year) do you guys thing, am i OK to sponsor??

2- Is my wife need to complete Medical test in India before i apply? or when CIC request? if so, without CIC request, will she able to go and complete test and get the medical report from hospital??

3- Should i pay all the fees together in CDN to Canada office since i have to submit all the application together by myself?? or when CIC request for each step by the office?

4- I requested option C from CRA, by the way, i am just wondering before i get, what is on there?

Your answers will be so much helpful, lots of thanks....

Arun

1) There is no minimum income requirement for sponsoring your spouse. But you need to show how you will be supporting your spouse once she is there with you in Canada. Applicants without any job have been able to successfully sponsor their spouses. Your income is good enough, no worries. Attach you pay stubs with your application.
Refer this document, read point 5.33 on page 23.
http://www.cic.gc.ca/english/resources/manuals/ip/ip02-eng.pdf

2) It is mandatory to do medical upfront for spousal cases. Your wife will get an appointment as it is for spousal PR.

3) It is advisable to pay the entire amount of fee initially to avoid any delay in the processing. The RPRF fee of $490 can be paid later but it would delay the file processing.

4) Option C is just to see if you were on any social assistance from the government. If you had any of that you are not eligible to sponsor.

Hope this helps.
All the best. :)

Hey,

Just to be clear, he is applying for you as a dependent on his work permit and not for PR correct?
