Hello Everyone,
Question: I have worked in US for few years on work permit(H1-B). Now my company has filed a new work permit and want me to go US by mid January. I would be required to submit my passport to US consulate once this work permit arrives(which I am expecting by first week of January).
Since my passport is already with Canadian Consulate and looking at the pace by which people are getting the visa, I am not sure what to do. Shall I simply wait for Canada visa and then submit my passport to US consulate(to which I am not sure how long this will take) or shall I ask them my passport back from Canadian Consulate(not sure the implication of this) once I get the US work permit?? Any suggestion would be highly appreciated. Yes have done my medicals in MAy and ecas status shows "medical results have been received".
My company is aware of my Canadian PR application. Our plan is to work in US for a year then will send me to Canada location since we have office there too.
Is it good idea to apply GCM notes in mid dec and find out whats happening. Based on that take the decision about the passport?
So are you working in India right now?
That's unfortunate that you are stuck right now. You cannot work in USA without visa on your passport but the passport is with NDVO. So you will have to ask them to send it back to you. Once you get US visa, you can send it back to NDVO when they will ask for it again. Since you are August applicant, you can expect NDVO to process your PR application anywhere from February to August. But if you are in USA and working and they may have to call you for an interview, you will not be bake to fly back to India without passport
Most likely, applying for GCSM notes will show no progress as May applicants are being processed currently.
So I would suggest asking the company if you can work in USA after you get Canadian PR but make sure that you will be living in Canada for the required number of years or your PR will get cancelled.
Good luck!
