More importantly, will your college even allow you to continue without a valid Study Permit?

My institution sends a warning message to me each time my study permit is near expiry letting me know that they will de-register me if I dont produce a new study permit.

As for it being the agents fault, can you provide detailed proof of this? Will he sign a letter admitting to his wrong doing and let you submit it to CIC?

You just claiming that it's his fault without documentation wont do you much good.
How does your institution know when your study permit expires?
If he is lying, then he will obviously not sign anything like this... But I've taken pictures for study permit and I sent email to the agent. Can't this show that I was trying to apply?

If it's more important for you to finish school - then stay until the end of August.

If it's more imporant for you to be able to return to Canada at some point in the future - leave immediately.

These are really your two choices.
Of course it is more important to be ablt to return... But finishing school is also very important...
Because if I do not attend this term's exams, I would have more than 10 WD's and therefore cannot continue to study and can not get a study permit anyways...

I tried call CIC to speak to an agent today. It says "press 0 to speak to an agent", and I did, but then it says "the information you entered is invalid".
Is there any problem with the system?

The Institution has a copy of your study permit so they will know when it's about to expire. It's illegal for them to host you as a student if you dont have a valid permit so they will de-register you.

What agent are you referring to? Is this person employed by CIC or is this a private agent helping you to renew your study permit?
Whichever the case it doesnt matter to CIC, you are the one responsible for making sure ur status is legal! Also u are never supposed to send your original permit to CIC, they clearly state they dont return any of the information submitted other than ur passport!
Regardless of who is at fault cic will not care if you sent emails to tge agent and I am assuming that this agent is not a CIC employee, since they would never help with renewing your permits!
You have not been defrauded, so you have no case for CIC! For all they care u have overstayed! I understand you might have not known what the process was like and what was expected from you, however there is a lot of information on the cic website! The most u can do is leave and reapply from your country, invluding the emails with the agent, stating u though ur study permit was being taken care of by the agent! I dont think it will make much difference but at least you might have a chance to seem less guilty of overstaying!
If this is ur last term ending in august, and u plan to return to china for good, u might as well finish ur term! And no dont tell any of ur friends that you are studyibg woth no permit bcs u never know what ppl are capable of!

No you misunderstood. The "agent" I was saying is like a constitution that was supposed to apply my study permit on behalf of me. I have over them the required information and they should apply for me. But they in fact never applied it and they said they did.

Ok so this is what I thought! In this case immigration doesnt care, afterall you are the main person responsible for your permit to be valid

hello jerome1989,

I'm sorry to hear about your situation. I would advice that you contact a reputable immigration lawyer with experience in this type of situation.

The rule says that if you let your study permit expire, you have 90 days to restore it and you should "stop" studying until you receive an answer from CIC. Technically, you've been studying illegally since March 31.

If you want to have chances of returning to Canada some day, I would stop studying immediately and get a refund from the school, contact a lawyer and leave Canada.
