I have a fiancee who was married in the Philippines, has a child by a husband who abandoned her before the child was born. The father has done a compete disappearing act, we have no idea where he is, but we know he left with another woman and has kids with her.

Because there is no divorce, i cannot marry her, how can I get her and our child into Canada? (our by mutual consent)
or are we doomed by the system

Would we have to live there in common law first?

You could move down there for a year to establish common law and go that route. Another thing that could be an issue, is the father, he could deny the child the right to leave the country with his/her mother, if he wants. So adoption might need to be considered by you too.
 
You need money to pay a lawyer in the Philippines. If you have no baggage why go with her? There are plenty of fish out there. If you are in her situation high chance she will find somebody else. I believe in love and I can love somebody else. I wish at the beginning she told you everthing.
