it is! and according to cic website, you are only asked for an arc if you were deported

this is what it says for departure

1. Departure Order (form number IMM 5238)

a) If you received a Departure Order and

left Canada within the required 30 days and
verified your departure with a Canadian immigration officer at the port of exit

you do not need an ARC. You may return to Canada subject to normal examination at the port of entry.

b) If you left the country without verifying your departure, or more than 30 days after the Departure Order was issued, the Departure Order automatically becomes a Deportation Order and you need to apply for an ARC (see point 3 below).

we did A, but for some reason the person filling out the paper circled depature becomes deportation on our certificate if departure..
i dunno if they put it in the system like that or if they just circled it on the paper.

because we have a letter that says we have a departure order to leave canada no later than march 31, and we left march 31. so technically according to the website we shouldnt have to get an ARC...
but it seems like cic and cbsa arent following this rule :-\
This is where "Ambiguous" best describes this process. The 30 days are not from when CIC asks you to leave. They start sometime after they make a decision on your case. Some few weeks after the hearing, but they never tell you "Mr. ---- starting now, you have 30 days to leave" For example, We applied for Humanitarian and Compassionate grounds, but that doesn't stop the counter on the 30 days, yes you can stay while it's being processed, but time is ticking anyway. So either way refugee claimants are screwed. I've gotten so many confusing answers from CIC that I'm not even gonna try to fight it. I'll just submit what they ask me for and hope for the best.

Yeah no kidding!!, they should really sort this out so people know exactly what the process is.
Even our immigration consultant wasnt aware of that. she thought the 30 days is when you meet with cbsa and they give you the date you have to leave by.
ridiculous!.

edgar do you know if this is where we would go to make a formal request of refugee documents

Also Edgar i think i know what you mean that happened with your family
because when my husband first applied for refugee he was asked to sign a 'removal order.' that stated he would leave Canada when the CBSA officer requested him to. but doesnt give any dates or nothing. it just says when he is asked to.

Yes that's where you can contact them. Oddly enough, there's a FOSS ID, which is what they use to identify your refugee claim, and I just noticed a week ago that the FOSS ID is the same as my UCI #

I had it in the decision papers. lol.

My guess is just send them an email with ALL the information you have, full name, date of hearing if you can remember, date of birth, current UCI and File number and explain the reasons for your email.

Another thing I just noticed is that the PDF they sent me says this.

Our records show that you were ordered deported on February 5, 2012. As you were previously
deported from Canada, you are currently inadmissible to Canada and you require authorization to
return to Canada if you wish to continue with this application for a permanent resident visa.

February 5, 2012? What the hell? That date has nothing to do with anything.

Nope lol. Just the prepaid waybill. When I get my PPR I'll just tell them that I rather pick it up in person. This is a time bomb, putting everything into consideration I should get my PPR sometime around November/December. If my wife is forced to spend another Christmas away from her family because of this I'm gonna be super pissed.

how often does your wife come down here to visit you
