My employer applied again on Jun 1st, 2016. In our last time, it took 20 weeks. I believe it would have taken about a month if they hadn't had to ask for additional documents (this request was exactly 1 month after the application).
hello Funbox,

Why did you/employer choose to apply it again?
is there a specific reason for that?

thank you

1. Yes. This will be a problem. According to ESDC website:
Employers applying for a labour market impact assessment (LMIA) must pay the temporary foreign worker (TFW) at a minimum, the posted prevailing wage for the occupation and work location where the foreign worker will be employed.
Employers offering a wage that is below the prevailing wage rate will be considered as not meeting the labour market factor for the assessment of wages and therefore, will be issued a negative LMIA.
Note: You also have to offer the prevailing wage in your advertisements.

2. Once the LMIA is approved and you get a work permit (not your PR) under this LMIA, your employer will have to start paying you the new wage. Unless you are already have a work permit and is working under this work permit that has nothing to do with a LMIA.

3. I'm not sure if I understood this question, but I think your experience will be valid. The LMIA itself will give you 600 points which I believe that is enough to be selected.
Thanks for your reply Funbox. Since I have PGWP and I am only applying for LMIA for PR.

1. My first question is, I am already working for employer and my employer is advertising with median wage now. So, the real question here is when will my employer start paying me median wage? after I get my PR? or after my LMIA get approved? (Remember, this is gonna be PR LMIA only.)

After getting PR... In the LMIA application ur employer agrees to hire u after getting PR, so he is bound to pay u the median wages after u get ur PR

The processing time depends on many factors like location, job position, whether all the required documents were sent correctly or not. It's hard to say a time because it is very specific for each application. There were people from this blog that got a positive LMIA within 2 weeks and people that are waiting it for more than 25 weeks. Good luck.

Yes, he can; provided ur friend satisfies other requirements. His job offer must say that it is permanent and full time job offer

Thanks Joejo for reply, Do you know anybody who have done LMIA for PR?

When i called service canada today. They told me median wage should come in affect once I get PR. But when my employer called them twice. They said median wage come into effect after LMIA get approved.

I have asked some lawyer and they said median wage come into effect after PR.

But now my employer is not willing for LMIA. Because he can not median wage right now or after LMIA. he said he can match wage after I get my PR which will give him some time

I am so confused now.

Hi all,

I have received the LMIA file No. in May and my wp expire soon. The Lmia I have apply is supporting PR and wp. Is it possible use it to extend my wp? or any idea to extend my wp?

The LMIA file number doesn't indicate whether your LMIA is positive or not so it is not valid for a work permit application. You will get a confirmation number when your LMIA gets approved, then you must use that one. You have an alternative solution as below.

I have not received a new Labour Market Impact Assessment from my employer or the Certificat d’acceptation du Québec yet. My work permit is about to expire. What should I do?

You can only submit your application without a Labour Market Impact Assessment (LMIA) or Certificat d’acceptation du Québec (CAQ) if your work permit expires within 2 weeks. You must include proof that the LMIA/CAQ request was made.

You must:

- include a copy of the application sent to Employment and Social Development Canada/Immigration Québec, or
- include a copy of the receipt confirmation number, if the request was done online, or
- indicate, in the section Details of Intended Work in Canada of the work permit application:
- the date the LMO/CAQ request was sent,
- the office it was sent to,
- the employer’s name, and
- the confirmation number for the submission, if available.

You must contact our Call Centre with the LMIA/CAQ confirmation number within 2 months of the date your application was received; otherwise your application could be refused.

Note: If you are waiting for your CAQ, you cannot submit your application online. You must submit a paper application.

Is it that means if they got a positive lmia before and they can use that to extend their wp until the new one get approve? But i am the first time to apply the lmia, that means i cannot extend my wp. Is it that true?

No. It doesn't matter if your employer has applied for a LMIA before or not. You can extend your work permit within 2 weeks before the expiration date of your current work permit. You will have to proof that your employer has submitted for your LMIA and you are still waiting the decision. When you get the decision, you will need to call to Service Canada and provide the LMIA result. If the LMIA result comes negative, then you will not be able to work anymore. You have two month to call Service Canada and provide the decision, otherwise you work visa extension might be refused.
