No. It doesn't matter if your employer has applied for a LMIA before or not. You can extend your work permit within 2 weeks before the expiration date of your current work permit. You will have to proof that your employer has submitted for your LMIA and you are still waiting the decision. When you get the decision, you will need to call to Service Canada and provide the LMIA result. If the LMIA result comes negative, then you will not be able to work anymore. You have two month to call Service Canada and provide the decision, otherwise you work visa extension might be refused.
Thanks for answer my question. so... I need to ask my employer the application form(All the information?), the payment receipt and prepare the application form of work permit extension(Using which form?), collect all information submit to cic. Then, I will allowing continue working in Canada?

You can choose either one or another. The LMIA payment receipt would be easier as it would not be a lot of pages. While your work permit is processing, your status will be "Implied Status". Implied status keeps all the rules that are valid for your previous visa. So you can keep working. I don't know which form - you need to search it on their website.

If someone working as a QA(IT) for last two year and have postive LMIA for Software Developer, now he should apply his immigration under QA or Software Developer.

Please advise.

I think you should go with QA. Due to your new offer effect only after your PR get approved. Just my opinion...

From what I know from before, apparently if that happened, CIC doesn't allow the company to apply for LMIA for 12 months, starting counting from the last day of a person being laid off.

Under which NOC code he suppose to apply ?
LMIA job offer id for software developer and his last one year work profile is in QA.
Please advise.
He should apply under QA for PR. His job offer supported by LMIA will give him additional 600 points under EE. If his QA experience is in Canada he will be eligible under FSW and CEC and if it is outside Canada he will be eligible under FSW.

Thanks Joejo for reply, Do you know anybody who have done LMIA for PR?

When i called service canada today. They told me median wage should come in affect once I get PR. But when my employer called them twice. They said median wage come into effect after LMIA get approved.

I have asked some lawyer and they said median wage come into effect after PR.

But now my employer is not willing for LMIA. Because he can not median wage right now or after LMIA. he said he can match wage after I get my PR which will give him some time

I am so confused now.
Kashyap272, I applied for an LMIA to support PR only. The job offer and the LMIA application clearly states that the employer will hire you for the offered position once you obtain your PR and successfully enter Canada.

In page #9 of the LMIA application, the employer is agreeing that 'I commit to hire the workers covered by this application on a full-time basis as per the terms of the job offer described in this application and in the LMIA letter and annex UPON ISSUANCE OF THE PERMANENT RESIDENT VISA'

So ur employer has to follow the terms as per the new job offer once u get ur PR, not after getting LMIA. It is simply because you cannot start working immediately after getting LMIA, u must obtain a WP (in ur case PR) in order to start working in Canada

The bottom line is ur employer has to pay median wage only after u get ur PR.

U can use IMM5710 'Application to change conditions, Extend my stay or remain in Canada as a worker' , the WP extension application. Once u apply for extension u will be on implied status and u can still continue to work until a decision is made on ur WP application.

U dont need to get the entire application from ur employer. Collect the file number issued by Service Canada that includes all the required information about ur LMIA application.

Thanks a lot Joejo. I finally found the right LMIA form. I will tell my employer about this.

Cheers.

Thanks Joejo, I have asked the lawyer and the other consultant, they say unable to working on it, they say my time is too short, not enough information to support and government will reject my extension. He told me if I go to apply extend my work permit, maybe I can delay 1-2 weeks because the implied status. I am so confused. I am following the question to find the form I need, and that means I am able to extend my work permit. Why they say I can not.

Hi guys!
Does anyone here received a positive LMIA for a low wage job in Saskatchewan?
My employer has a file number already. The consultant applied last April 11 until now no decision yet.

U can use only that form to extend WP.

Did your employer already applied for LMIA? When did he apply? When will ur WP expire?

What the lawyer said is correct; u cannot get an approved WP without a positive LMIA. But if ur employer applied already for an LMIA and received a file number, u can apply for an extension and avail the implied status. U can do a paper application which takes around 100 days to process. So if u get a positive LMIA within that time, u can update it with CIC and ur WP application will be approved. Otherwise u will get another 3 months on implied status, but ur WP application will be rejected.
