passenger , you can write a letter stating you cannot provide them your divorce certificate as the divorce proceedings are still on. You should support this statement by including a letter from your lawyer/ court where your case has been filed. This letter should clearly mention about the current status of your divorce proceedings. Also assure them you will provide the concerned certificate as & when it becomes available.
Dear RKC
Thanks for your support and reply.

Is it possible they reject my application due to this matter?
Unfortunately we did not bigin any legal process for divorce.

Last date is 31-Aug-2011. You have no reason to worry sir. You are in a NOC whose cap is still far away from being full.
Its Pharmacists (3131) and Restaurant Managers (0631) who are hanging by a thread

I too had the same problem in my first application and got 65 points coz only 1yr experience was counted the other one was i had only send my reference letter with no job description but contract and also had called, faxed and emailed cio requesting to reconsider my application, mean while i will be able to send the new one with all description from the place i worked but they said no further documents are accepted after a decision has been made so i quitted and resend a new application
But u can still try ur best sending them request. Good luck.

I got NER , coz of my stupid lawyer , i had two jobs , the 1st one 3 years experience , i sent detailed work experience letter with job description , and it got approved , the second job for one year , i just sent job contract without job description , as my stupid lawyer said that the contract is enough and i don't need to send job description.
below is the letter i received from CIO .

question : do u think i can send them e-mail to explain and tell CIO i can send detailed job description for the second job?

Unfortunately we did not bigin any legal process for divorce.

But you've mentioned in your app that you & your wife are legally separated...that is why VO is asking you to provide either divorce cert or status of your divorce proceedings.

If you hadn't begun with the proceedings then why did you mention 'legally separated 'status in the form?

You should write them a letter explaining the whole situation regarding your marriage truthfully. You can also start with filing for a divorce & include a letter from your lawyer.

Thanks a lot RKC..
i have already intimated ND VO of the same and will let everyone know what all docs etc are required...

Our LVO does not send aors nor does he communicate to us anything but MRs....
We are supposed to hear from them 3-4 months from the PER date so we have 2-8 more weeks of waiting. The only sign that can tell us that something is happening with our files is the appearance/disappearance of our addresses on E-cas so keep a close lookout on it (even on weekends).

Don't worry about LVO, they take time only because they are the busiest of all VOs.

Hello Big O,
I am a LVO applicant as well and my time line is the same as yours. I am a bit curious about your comment 'We are supposed to hear from them 3-4 months from the PER date'. This seems to be too fast from London. Have you heard of any applicant get a response in this time frame. Please let me know.
Thanks,
ASMB

Hi ASMB,
Based on MI2 timelines, and CIC "commitment" to us we should hear from them in 3-4 month (for a complete file processing within 12 month). Of course that varies from applicant to another based on his file and the background and the security checks.

Applicants from MI1 & MI2 who have not made it in 12 month will have to wait untill MI3 Applicant processing is completed (as per Mr. Kenney statement in the house of commons). I am not sure when will they start looking to older applications or how do they balance the work load between the different MIs however one thing is for sure: those who applied in July like you and me will have faster processing.
