The person on implied status can remain working (with the same employer under the same conditions as the original work permit ) until a decision has been made. That decision can be positive or negative. If you paper work is incomplete and they send back your application you may lose your implied status.

Once your application reaches stage 1 you should receive an open work permit only than can you look for a different job.
thank you. But there is current issues about foreign workers now specially on food service that they are not issuing work permits anymore. Will he be affected by that? And if the package is returned what is our other way? Please help.
 
i don't know what I would do if my wife were in the food industry and had a permit expiring in June 2014 to be honest.

If it were me I would make 100% sure my application is complete
I would provide as much evidence of a genuine relationship as I could, joint life, joint bank account, joint credit card, lots of photos, chat logs, SMS messages,
joint health benefits,

I don't think they would return an application unless it wasn't 100% complete.

If my application wasn't 100% complete I would make sure I explained the reason.

For example in our application we are missing a police record check from Hong Kong
but they will not issue one without a request from CIC so we explained that in the application.

Id also make sure as of the day I mailed the application I was using the correct forms.

If this is a common law relationship Id even provide more evidence.

The biggest issue is if you mail the application now it will not even be opened until after the work permit expires

I would probably speak with HR (of work permit holder) and make sure they know I will be on implied status.

In the end of the day if the package is returned you would be out of status.

(Sign the petition and have your Sponsor sign it)

I don't know if you can get a visitor permit as a backup so at least you have status.

Pud it in your application that you sent an Inland application for Family Sponsorship. Some people here were granted for 1 year extension which is good since most of the Inland Applicants for 2013 had their PR in less than 12 months.

I don't thing that the issue with the temporary foreign workers has anything to do with us, because with an OPW you don't need a LMO, you are free to work anywhere, that's a completely different story
If you already submitted an OWP, you don't need to apply for visa extension, that's enough, your husband has an implied status.

he is in line with renewing his work permit 3months ago but that time we arent ready yet to submit out application because of some documents that moratorium happened that is why we somehow rushed into it but it is all complete we just have some documents that arent sure like option c and marriage certificate because we need to wait 5weeks for it that is why what i included is a computer printout from cra and a marriage certificate that the judge gave us. In short, we arent sure if it will come back or not, that is why i wonder if he would still be implied if it comes back or do we need to change to visitor visa. :(((

sophiee thanks for ur reply would it hurt us if we submit an application to vegreville to change his condition from worker to visitor? Evento we have an IMM5710 in our spousal? Super worried.

I got confused, your has an OWP right now, or he is a temporary foreign worker?

If he has an OWP right now, and you applied for OWP with your sponsorship application, than he can continue to work while your application is in process, so he shouldn't change his status to visitor.

If he is a foreign worker, than (AFAIK, pls correct me, if I'm wrong) he won't be able to work after his permit expire. But he will get implied status with the OWP you sent, so he will have legal status in Canada. In this case you don't need to change his status to visitor, but it won't hurt either.

You are a nervous wreck!! You have already sent an OWP which should give him implied status, which should be the most important thing.

I strongly advise you to call CIC on Monday and then call a lawyer (most offer a free consultation) and get a straight answer. We are all trying to help you, but you keep asking the same question over and over!

You can try, but as you are out of status, you may have problems when you try to get a work permit to go with the LMO. You DO need a work permit...
 
I know a company that can hire me with their own open LMO, I don't know if I can stay at home 8 months without working. I will surely get bored and go crazy.
