Hello! I have am new to the forum here, though I have been obsessively reading this one and the 2013 one for months. I don't want to bore people but I would like to share our story here so people know who I am: I'll try to be brief
My husband is from Haiti - he has been in Canada for 7.5 years
He applied, and was rejected for both refugee status and H & C grounds. His rejection for H & C came about 2 years ago
He was never deported or asked to leave Canada as Canada had a moratorium on removals to Haiti for many years
We met and began dating 5 years ago, moved in together 4 years ago and got married 2.5 years ago. We have never lived apart
We applied for Inland Sponsorship on Feb 12/14 - app received Feb 13/14 and AOR received June 17/14.
Until we applied for the sponsorship we did not know my husband was subject to a deportation order that was not enforced because of the moratorium. We thought once we applied for Inland, he would be safe until a decision was made like everyone else. This was our responsibility to know but honestly we were just living our lives and didn't think the way we should have. Thank goodness we got a lawyer who explained this to us but I of course have been kicking myself since for not applying sooner.
She also explained that we NEED AIP for my husband prior to a removal order. When we applied, stage one was taking about 7.5 months and so we applied. 10 months later and the processing time is 16 months and the moratorium with Haiti lifted Dec 1/14.
The lovely government has said people from Haiti have 6 mos to apply for H & C and will defer removals until a decision has been made but did not make any mention if removals would be deferred with other types of permanent resident applications like Inland Sponsorship.
I have reahed the point where I am half losing my mind with waiting waiting waiting!! I am terrified this process will just continuously get longer and longer, and my husband will get deported before we get a decision - this is the most stressful thing I have ever dealt with!
My husband has been able to work throughout this and so i never signed up for the forum before. i hear the many stories of how this long process is practically bankrupting people and my heart goes out to all of you. I just felt like i wanted to join a place where other people understand some of what we are going through. Thank you for listening.
