Work Eligibility for Expired PR and Not Meeting RO

Here's something from an Inland Enforcement Manual that may help the OP: 11.2 Verifying PR status The Permanent Resident Card is the best evidence of PR status in Canada. The following documents may be satisfactory indicators of permanent residence...

Work Eligibility for Expired PR and Not Meeting RO

Well, you have admitted that even though you were able to successfully return to Canada last month, you are currently in breach of the R.O. to maintain your PR Status. This is a bit of a quandary, IMHO. From IRCC (formerly CIC) op10-enforcement manual, pg 18: 8.1 Holders of...

Inquiry Regarding PR Status and Sponsoring Spouse After Returning to Canada

If things happen the way the OP is hoping (they reside abroad, together) and the spouse's days do in fact count towards the R.O., simply applying for a PRTD if they need to return to Canada (to visit) is the logical choice. Choosing to go through a Spousal Sponsorship would be crazy and expensive.

Inquiry Regarding PR Status and Sponsoring Spouse After Returning to Canada

Here it is in a nut shell: A PR that is accompanying their Canadian [citizen] spouse or Common-Law partner abroad can [usually?] have those days abroad count towards the required 730 days within each rolling 5-year window...to maintain PR Status. There has been much discussion regarding the...

Inquiry Regarding PR Status and Sponsoring Spouse After Returning to Canada

Thanks. You don't seem to understand that since your spouse is already a PR of Canada...there's no need to`sponsor' your spouse. Your spouse will need to renew their PR CARD once it expires, but not their PR STATUS as it does not expire. Just curious to know when you were married.

Inquiry Regarding PR Status and Sponsoring Spouse After Returning to Canada

Your post is a bit confusing: "I hope this message finds you well. I am seeking clarification regarding my Permanent Resident (PR) status and the process for sponsoring my spouse for PR after we return to Canada. To provide some context: I am currently a Canadian citizen." So, are you a PR...

I have a DUI conviction, am I eligible as a sponsor

You're understandably overthinking this, yet the link makes it crystal clear: You may not be able to sponsor if you… are sponsoring a spouse or partner but you signed an undertaking for a previous spouse or partner and it hasn’t been three years since they became a permanent resident...

Canada re-entry on Open work permit

It's possible that this is a date indicating when you must leave Canada. Since you have already left, that stamp may now be moot. Best to contact CBSA to find out, rather than relying on people on a free, public forum to offer their `opinions'.

Spouse or Common-Law Partner in Canada Class

He could apply via the SCPLC (Inland) spousal sponsorship even if he did not have legal status. This is only available for an Inland applicant. When you refer to him as your `spouse', do you mean your marriage partner/spouse. I ask because sometimes a person that is in a Common-Law relationship...

Traveling While Waiting for Spousal Sponsorship

Yes, but it's a moot point for you. It's amazing how many people do not understand that an Outland application can be submitted from Canada. The onle potential downfall would be that if the applicant is required to appear in-person for an interview at a foreign office.

Canadian citizen accompanying PR spouse to the US on H4

    Here's a thread worth reading: https://www.canadavisa.com/canada-immigration-discussion-board/threads/who-accompanied-whom-can-matter-for-prs-living-with-citizen-spouse-abroad-update.579860/

Traveling While Waiting for Spousal Sponsorship

    (a) is actually a requirement for a SCPLC (Inland) applicant, not an Outland applicant (which can be submitted from inside Canada). Submitting an Outland application assures that if, for any reason, the PR applicant is denied re-entry into Canada, their Outland application continues to be...

That was intended for her non-citizen spouse, even though I used `you' in place of `your spouse'. LOL!

Traveling While Waiting for Spousal Sponsorship

So you actually arrived at the PoE with all your `stuff'?! Yup...that was a bad idea. Glad it worked out for you! CBSA officers have an enormous amount of power (as they should) and your story could have had a devastating end. You could have been given an Exclusion Order banning you from...

Canadian citizen accompanying PR spouse to the US on H4

Familiarize yourself with discussions in this particular forum regarding `Who followed whom'. Since your spouse is already a PR that has been living in Canada (with you?), it's a mitigating factor that may be positive; they have `established themselves in Canada. However, since YOU would...

PR card renewal - Questions reg. out of status, need expert opinion.

A person that is not in Canada, holding an expired PR Card is `assumed' to be out of compliance in terms of the Residency Obligation. That is not to say that any action would be taken by a CBSA officer once the PR returns to Canada. Waiting until you have returned to Canada and accrued more...

Traveling While Waiting for Spousal Sponsorship

I have never heard of this...which doesn't mean much, I suppose. The PR card does not invalidate anything. it is simply the official `proof' that the person has obtained PR status that is mostly used for returning to Canada via a commercial carrier. Since your husband is a U.S. citizen (with a...
