Hi all,

My 2nd year IEC expires on January 3rd 2014..

My Current passport expires on May 20th 2014.

I have my In-land Permanent Residency Application ready to send out with a Open Work Permit application So I can continue to work while I wait for my application to be fully processed.

I have to send this application out ASAP as you know the 1st stage on the In-land application takes around 6 Months and at the 1st stage I can receive my Open Work Permit.

My issue is that my passport runs out May 20th 2014 and I can see this causing big issues. Firstly If I get my Open Work Permit in 6 months time I think they will only have it valid until the end of when my current passport expires(which will be May 20th 2014) This will not help me at all as I need to keep working and stay in Canada during this whole application process. What will happen?

In regards to my main application, By May 20th 2014 when my passport expires I know my PR application still will not be completed due to the processing times, Will I just have to send it my new Passport details?

My Lawyer has told me that I can stay using Implied Status and he has given me a document from another one of his clients that use him, its from the CIC and it states that since you have submitted a Open Work Permit and your application is in Progress that you are on Implied status.... Ok that is great however how to do prove that to your employer? If you SIN and Work Permit both expires at the same date how can you extend that using Implied status?

As far as the company I work for or any company in Canada need Proof you can continue and work in Canada, if your SIN and Work Permit has a expiry date then that's it, you cant work any longer...

So under Implied Status can you go back to the Service Canada Center and get a new SIN/Work Permit? how does that work?

Today I became a Permanent Resident of Canada :p :p
Interview was at Scarborough CIC, whole process took almost an hour. There were about 9 other couples there.
They called us in, told us to check if everything was ok on our confirmation of PR document, signed it. And told us about our rights of being a PR. After that they said that we can't travel with the confirmation of PR, but have to wait 6 to 8 weeks to get the PR card, which is ok with me coz i have to renew my passport anyways. Then they told us we will getting our permanent sin #s :D :D which we did.

All in all i'm done, now i have to wait for 2 years before i can apply for citizenship.

You'll have to renew your passport at some point. Do that before your work permit expires and then apply for an extension of your work permit - or if you get a new passport before the OWP issues, send them an updated copy to add to your file.

You can certainly do so, or you can wait until the landing interview (the COPR will list your passport information on it in any case).

Confirm with Service Canada, but in general you cannot extend the expiration date of your SIN without a new work permit. CIC is not responsible for the policies of individual employers and they are generally allowed to use stricter criteria than are required by law. It sounds like that is the case with YOUR employer. If they do not wish to continue your employment under implied status, they can certainly do so. Note that you will be eligible to apply for EI benefits, as that would constitute involuntary separation without cause - legally you can continue working under implied status.

Implied status is a legal basis for continuing employment. Your employer may insist that they only accept evidence from Service Canada, but other employers will accept a paid fee receipt (for example). Here's the Service Canada web page: http://www.servicecanada.gc.ca/eng/sin/employers/responsibilities.shtml - note that it does not indicate there is an ongoing obligation to confirm the SIN has not expired. It is a requirement that it be verified at first employment. Were I an employer, I'd want a copy of that original SIN and a current work permit - personally, I wouldn't care if Service Canada had not yet extended the expiration date of your SIN, since that work permit is really the key legal point.

I cannot find anything suggesting that you can, but ultimately the real authority here is Service Canada!

I just called CIC refer to my status.

The lady was nice but nothing new as you all known "they are working on the 8Oct'12 still"

Just wait for AIP + OWP which don't know how long will it take and once they come, they come. ::) ::) ::)

WHY didn't they change from 6 months to 8 months in this point?
They will, but that will require a 3 month wait while they type it out.

Congrats on landing and getting your PR status.

However I do dispute your claim to wait 2 years before you can apply for citizenship. I think you meant to say 3 years to apply. You can apply at minimum 2.5 years as PR to qualify for citizenship as you can claim your time as visitor in Canada towards citizenship as half days up to a maximum of 6 months total. The agent told my wife that she can qualify for Canadian citizenship in 2.5 years since she has already stayed in Canada for a year maxing out her 6 months contribution towards citizenship qualification. Now she only need to complete 2.5 years to get citizenship.

The idea is good but the wording is not very convicing. Yes all applicants wish processing times were faster, and they should be! But you arent makiing a strong case for exactly why.

For one thing, CIC purposefully processes inland applications slowly as a method for encouraging outland applications and discouraging inland applications. So processing time are not "as fast as they can be" but are actually designed to be slow on purpose as a way to punish inland applicants. This is wrong, and believe me, all applicants are "punished" enough by the process without needing any extra punishment. The punishment aspect of inland application wait times needs to be removed and resolved. CIC should be committed to processing all applications as quickly as possible, there should not be built-in mechanisms for ensuring inland applications are always processed slower.

Actually 2 years only, i have been in canada since 2008, and have never left. the IO told me that since i have already stayed 2 years in canada, i could qualify to apply for citizenship in 2 years, i have also tried using the citizenship calculator, and its showing me that i have 738 days, each day i have been in canada before becoming PR counts as 1/2day, if don't travel for the next two years i will qualify on June 19 2015.. but i am obviously going to take vacation this year for about 3 weeks outside canada, the same for next year, for 2015, i will try to take vacay towards the end of the year, after i have applied for citizenship ;) ;)

That's great news. They must have removed the visitor half days limits. I could have sworn that I read some years/months ago that you can claim your days as a visitor as half days up to a maximum 6 months. So a person who worked in Canada on temporary work visa could apply for citizenship the day after PR status if he/she worked on temporary work visa for 6 years prior to being granted PR.

You only got 4 years to get citizenship, 2 years to qualify and another 2 years for application process.

I knew about the half-day thing for time spent in Canada before PR. I've not read anything about limiting that to six months. Here's the link: http://www.cic.gc.ca/english/helpcentre/answer.asp?q=355&t=5. Six months isn't mentioned there, but it wouldn't surprise me if the information is not complete.

It is not so much to discourage inland applications by going slow with process. It is more of an argument that the couples are not separated during inland process so there is no hurry to complete the process.

They want the outland process to go faster on account that they want the couples/families to be together asap. Outland applications always carry a higher precedance over the inland applications.

As much as you view the CIC agents in vegreville as heartless and cruel for making you wait so long. Which is more cruel? Together with your spouse for 2-3 years but unable to work or not being able to be with your spouse for 1 year or more years?
