I sponsor my spouse in family class with in canada the letter from cic is from here in vancouver but the cbsa want them to send his back to his country is there a possibility that they enforce him to go back
 
If CBSA has already started Removal proceedings...he may not be allowed to remain in Canada...even with the Inland application that has been submitted.

The Inland application is helpful for those are not already Removal ready.

It's important to understand that CIC and CBSA are not the same entities. CIC needs his police letter (PCC) and a copy of his passport, since it's an inland application. I don't believe Inland applicants actually need to send their passport. Perhaps this differs, based on his nationality.

If CBSA asks for his passport...that's not a good sign.
 
Hi ponga my spouse was a refugee claimant and cbsa want him to send back home and then i sponsor him his passport is in cbsa possession then i went to the cbsa and i asked for his assistance because we need a passport renewed so we can submit to cic.and the officer told me that he can get his new passport.and he will send it to my embassy so he can get a new one.for us to submit to cic.

Have you already been approved as his sponsor?

Has he received AIP (Approval in Principle)?


Either way, it sounds like CBSA is trying to work with you/him...which is good.
 
I think so they approved me because they not gonna asked him to go through medical and asked for his additional requirements if im not qualified to sponsor him.what do you mean approval in principle?

You would know whether or not you have been approved, because CIC would have emailed you the approval letter.

An Inland applicant receives AIP when:

1. The sponsor has been approved.

2. The relationship has been verified. At this point, the applicant is now [officially] eligible to apply for PR, even though they already have.

The medical and security/background checks are all part of stage 2 (after, AIP).


For a person that has problems with CBSA, getting AIP means that they can usually breathe easier. Once CBSA sees that an applicant has AIP, they usually back off until a final decision has been made on the PR application.

IF he truly has AIP, you probably don't need a lawyer.
 
Hi ponga one more question when i received a letter from cbsa that was june 17 they sending my spouse back home and they already give him a date it should be on july 22 and then june 20 the cic send me a letter they asking for additional requirements like passport and background check but prior to that the cic send me a letter that they received the medical exam.my spouse dont have a status here in canada but he have a open work permit.when we went to cbsa and asking for his old passport because we need the old one to apply for a new passport the officer told us that they will send it to our embassy and then they did they send it to the embassy.my question is do we still need a lawyer?because the cbsa officer told us that we need to file for motion?

I suggest you get an immigration lawyer, because your case sounds complicated.
 
CBSA will not give you back your husband passport once he is on a removal order. If your application was received at the CIC office before CBSA made the decision to deport him then you should not have to worry. If they received your application after making their decision to remove him then he will have no choice but to leave.

If they received your application after they made their decision to remove him, my suggestion would be to withdraw the inland application and put in an outland one. Get all the documents and applications and send it in ASAP. Getting a lawyer might be a good idea as well.
