This is for applications for permanent residence, and an H&C is an application for a "waiver" in order to process a PR application from within Canada.

If a person gets AIP, then they'll be applicants for permanent residents but not before then.

The only non-routine H&C is the one where there is no compelling hardship.
There are some applicants here and in facebook group who involved MP and IRCC get back to them saying their applications are non-routine. This is before AIP. Non-routine applications apply to any type of application even for citizenship. H and C is permanent residence application and AIP is just eligibility pass. When you check any H and C on eCAS, it will show we received your application for permanent residencee on specific date.

It has been my understanding that AIP isn't simply an eligibility decision because eligibility is decided against the Regulations that bar certain applicants from seeking to apply for H&C considerations in the first instance. Even a possibly compelling case for consideration won't be seen because of ineligibility.

I was guided by an understanding that eligibility was the thing that they call, "eligibility."

But look at Canada! They have service standards for inadmissible applicants.

So, I have to wonder what a routine H&C would look like and which compelling unusual hardship is usually seen?

I guess that it is usually unusual for someone to require to apply from inside of Canada because... (add a usual unusual circumstance here).

I'm done - the constituency workers must be correct.

Thanks. I've requested for GCMS notes which I'm told will take 30 days. My lawyer said he sent them a mail demanding the basis for refusal. Is it advised to wait for the reason or request reconsideration ASAP?

I may not have recognized a message from you as I dither and fuss over my mundane daily routines and personal messages have never been my thing.

On-line tracking for any immigration process isn't my area of understanding, however H&C is something different from the economic and family-based lines of business for immigration. Shoot me, or hack me to death, but H&C is the backdoor and it doesn't get lots of money for processing because.., it's the backdoor.

What can actually happen to an H&C after it is acknowledged as received, and what indicates that a decision is just about to be made? I doubt that this can be identified with any confidence through any of the information that they input into their system.

There is busy work for clerks for applications sitting on a shelf. Perhaps someone drunkenly rolls a car over a person in Canada. The person has an undecided H&C, so they decide to run all undecided H&C applicants under a criminal check to see if there are any that they can prioritize as criminals and refuse them and then move on.

Oh boy - action - they ran my file for a criminal check so I must be getting close! Nope.

An H&C is in process until it is decided and every time they do something it lands on their tracking system and whatever it was that happened, if it wasn't a decision then it doesn't much matter.

You amigo - you need to operate in an organized fashion where this application has evidence added to it routinely. Screw checking for updates and instead make it your business to collect material to add to the application.

You may want a fast decision, but look to prefer a positive decision and find resources that will help you dress that application up so that they will say, "we can't let this guy get away!"

I get the anxieties and I'd be lying if I said that I can even imagine 1% of the realities of this tension. Time spent looking for updates and reading the tea leaves could be spent reading the policy objectives, and asking your barber for a letter of personal support saying that you have nice hair and would make a fine Canadian (ready to bitch about anything at the drop of their knitted toques).

I think that you'll still be here in ten years, so get cracking on looking good on paper and get a punching bag for home so that you only smile when you go out. Then you can be landed and invite sketchy friends and deadbeat relatives over to join the party.
