If IRCC shifts focus on Ukarnian, then they will end up having the same backlog problem in 2023. If IRCC wants to focus on Ukrainian crisis, they will hire new resources so that it would never affect the backlogs from being processed.

I have had very similar thoughts and I ended posted only one which is similar to you Point (9).

Frankly speaking, your analysis is based on several assumptions. 1) We are assuming that there are no more CEC draws until the summer, which is a very big assumption; 2) We are assuming that IRCC will not shift resources to something else (Ukrainian crisis); 3) We are assuming that processing mean landing and not getting a final decision and thus, closing their PR application; 4) We are assuming that they will actually care about upper limit which is not guaranteed. They can strive to hit 55K (a target number), which results in ~20k of applicants to be processed in the next year.
3 is not really an assumption. There have been ATIP last year showing that backlog is split into 2 inventories. Processing and landing. You are still in their backlog until you land. Or else there should have been better numbers at the end of last year when general processing of FSW resumed in November, but the numbers remained the same as prior months, because those landed this year and they are the increased 800 per week folk.

Mandamus, one option if you have 3000-10000 spare cad. You'll get the decision in a month.

Looks like the immigration lawyers lobbied heavily to push people to pursue Mandamus. Why would Steve talk about Mandamus randomly?? Looks like its a coordianted effort by the law community. Even if I could afford, I won’t be giving even one $ to these a$$holes.

Thanks. In that case, it does seem like the numbers they published are not really surprising. They essentially reinstated that they will spend 2022 on landing (AKA processing) backlogs for FSWs and CECs. Certain people will be pushed to 2023 quota (family composition change mostly).

As you know I don't trust this pricks, but I don't see it that bad for post Aor especially with eligibility passed ,Like @Alysson said they have 50k in inventory and planning to land 50 k fsw so in the span of this year we should get it.
Under conditions
No new fsw draws this year
They don't cancel application (very less likely almost impossible)
And if they are not considering that along with cec (I didn't read it fully as I am traveling)
No new covid surge
In theory we should be able to land in 2022 but again dealing with ircc

Guys, I’m flying to Australia tonight.

For anyone who’s wondering how I ended up here - went to Australia for bachelors but had to leave as I had no pathway for further visa. So applied for masters. Spent 10 years in Aus trying to get PR but didn’t have enough points. Left Australia and started looking at Canada, missed the Dec 2020 draw by 2 weeks and again life came to standstill. Thankfully after lot of efforts I got employer sponsored PR in Aus.

Even now I’m heading there on money I’ve borrowed from friends as I quite literally have no money nor do my parents but it’s a new start for me.

My point being don’t lose hope and do whatever u can with the time u have… we’ll eventually get to our destination.

I’m honestly just being over optimistic. The reality will probably not be as great considering who we are dealing with. This is just tiresome.

Mostly they are worried Indian citizens having citizenship of another country will use it to "sabotage" India or buy all farm-land or steal all beautiful fair girls or these days ... cows.

I don't think there are legal provisions for filing a class action lawsuit against IRCC for delayed processing. The best you can do is wait for 18 months post AOR and file a mandamus, if you can afford it. It is going to be expensive, but from some cases I have seen so far, it does seem to move along processing without even going to court.
IRCC is a service provider and the applicants are the client. There is an implied contract when they charge you fees for processing application. Them offering you invitation to apply for PR is them making an offer and you accepting that invitation and applying is the acceptance of the offer and consideration being paid (fees). These are the building blocks of a contract. offer-acceptance-consideration. They may escape liability under contract since they did not legally promise any specific timeline for processing, however they can still be liable under tort, specifically personal injury. A service provider is bound by certain service standards when charging for the services even if they contracted not to be bound by any such timeline. They can even be charged with fraud for charging for services they did not intend to provide. It all depends on the lawyer you engage and how much interest they have in taking such a matter. I have been talking to people regarding this that IRCC breaks laws all the time without having any legal ground just because, they themselves don't know their actions are exposing them to legal risk and secondly, no one has questioned them on their methods. And the reason nobody has questioned them on their methods is that a majority of applicants are people who believe they do not have a legal standing or think that suing a government entity will affect their chances of getting PR (honestly, the latter category is mostly the idiotic fucks from the forever hopeful cult, I have even stopped appealing to them because I know that they can't even comprehend the basics of what we are talking here). Lastly, you'll need different type of lawyers for this thing. If you are just concerned with your application being processed, your best bet is an immigration lawyer for mandamus, but if you wanna question their illogical and shady methods, you'd be better off with a personal injury lawyer, immigration lawyers are practically useless for such issues. Its similar to going to an eye specialist for a stomach problem. Useless. I even joined a WhatsApp group with people who were actually active and considering legal action but after a few discussions it was realised that most were only interested in getting their applications sorted and didn't care about the rest and hence, the class action would fall apart if people don't stick together. And that's what's risky, people wouldn't care if in the middle of the case if a decision is made on their applicaqtionand would leave the suit midway with only a handful left who are stuck in the limbo. And the handful left may not be able to continue the case for financial reasons or a multitude of other reasons. You need people who'd be willing to stick till the end. To be honest, its going to be a very simple case if people go through with it. They do not have a single line of defence. No justification of why CEC applications from Oct-Nov 2021 are finalised while FSW from 2019 are pending. No justification of why approximate processing times are not being provided or no communication is being made or even enquiries not being entertained (it actually resembles the actions of a fraudulent business entity, who does not respond to your concerns once you've paid for their services). And the biggest, why they are making false claims that PR applications are being processed within 6 months when clearly they are not. (That's the biggest claim if you want to highlight fraudulent intentions). They are used to a lassies-faire way of functioning because no one has ever questioned their services and most applicants believe that they are the ultimate decision maker of one's destiny in Canada.
