Only that won't it be misrepresentation?
Not necessarily misrepresentation. At the time of application they weren't married so no false information was provided. However, IRCC requires every applicant to update them about any change in their circumstances. Getting married is a huge change.

I believe she will now need to do a Family Sponsorship application to bring him into Canada as he can no longer be included in her PR application.

That application will go to the bottom of the pile and gather lots of dust before ever seeing light of day.

This is a general plan B that I have

1.Use pnp option I can file as a Mechanical engineer as I have undergrad degree and experience in that.Alberta invites us usually.,i can also apply for supply chain analyst as i mentioned earlier i was a slave in my company i pretty much put everything i did in papers in what ircc needs.
2.Education - i don't give 2 fucks about Canadian degrees as I already have a us masters as I am not over staying in us and didn't create any issues chance of rejection is less even though not 0.I will apply to my favorite lambton college
3.My gfs occupation is in demand almost everywhere in this world but as I said earlier I was too overconfident I told her I can handle it but she told me if situation comes she can step up.

I gave you just 3 there are still more options left.I am concerned about my loss of time man this is draining my valuable time that I can start a family and move to the next phase of life than dealing with fucking immigration after immigration.
Your 3rd option is my plan B except that my Fiance has got an admit to a Canadian University and has already applied for a study permit. Typical Tech worker. Thank god for these Indian women who will save our asses when we get royally fucked by IRCC. Coz, my fking h1b is expiring in Feb of 2023.

But he can always file a visitor visa ,seems like this guy is a H1 holder ,he can visit her every 180 days a year. I don't think in this case doesn't affect him much

If he needs a visa to enter Canada, he is screwed. Chances of refusal for a visiting visa is high as he is married to a PR holder so no stronger ties back home.
Also, it doesn't sound like he is in the US - seems like only his wife is?

Trust me it is not an issue for this particular case because for example let us take your case .you are a h1 holder, you live in Detroit. If your wife is living in Windsor or something I don't think it is even an issue, similarly she is hr she can work in Detroit and live in Windsor. She just have to pay the tax ,Canada border (land) don't give a fuck .

He is why I said that because he mentioned H4 ,if she is in h4 ead that means he is h1 holder. Trust me h1 is a slave visa once you enter US with that if you want to be on status you don't want to go out.

If he didn't even apply for a visitor visa he is a total dumbass

Actually, thats true. Lot of folks drive daily from Winsdor to DTW for work and manitain both the status. But, I would never want to do that. Its like walking on fire daily.

Oh gotcha. Not quite clued up on how the H visas work in the US.

Still, IRCC makes it hard to get visiting visas if your spouse is PR or Citizen - the whole 'home ties' what-not. They are also not gonna take kindly to them willfully choosing to not update their marital status post e-APR.

If I was him , I was planning to do some stupid crap like this atleast I would have applied for a 10 year visitor visa before marriage.
"Risk comes from not knowing what you are doing "
Warren Buffet

Seems like this dude didn't even have slightest clue about what he was going to do.

As he is a H1 holder he should know all this I think he was just being reckless.

Reduced doesn’t mean dead so yeah. Also, the increased time is expected, since the time in an app only registers once it’s completed and almost all FSW applications are already 12 months+ now, and all these late applications will count towards this year. Also, it’s interesting that they requested extension on pause on draws until end of January. I still expect draws February, though it might be CEC.

I'm not sure I got the 36 months thing. Is this processing time for people who would be invited this year (2022) or for people like me with AOR nov 2020?
