The guy's permit is expiring in Feb15, and his wife's - in Sep15. We are now in Oct14, so there's no valid 1 year work permit that would grant him the power to chose CPC-O.

Incorrect. The requirement is that you can choose the VO of your country of (current) residence if you HAVE BEEN legally admitted for one year. NOWHERE does it state that you cannot choose that VO if you will not continue to reside there at some point in the future.

If one doesn't have valid work permit, then obviously, we cant put that vo.
But, even if one has just spent a few days residing in the country, but still has a valid work permit for 1 year on the day of application, he can put that VO.

I have a query " I am on OWP (since 25 July) in Toronto n got an offer from one of the banks on 20 Oct. I have applied under 2174 on 21 Aug. Since the cap is already full for 2174, if I send my Offer to CIO will they accept this n consider my application over and above the cap without LMIA"

I think the ministerial instruction are clear. They said that this program will remain open until the cap fills( 25000) or no new ministerial instructions order CIC to do otherwise. If new ministerial instruction published in January 2015 orders CIC to stop, CIC would simply follow new instructions and close FSW.

Not quite. It will remain open until April 30, 2015 or until the cap fills, whichever comes first. The only thing that can change this is a new Ministerial Instruction, which is possible of course, but it will be published like any other Ministerial Instruction; you certainly won't hear about it first from a call centre agent.

Century...A minimum of a Masters degree is required for University Lecturers. No Nigerian University for example, can allow you teach without a masters degree. same is applicable in Canada.

NOT TRUE. The "employment requirements" of the NOCs are not relevant. Only the job duties match matters.

FSW is not a job interview, and the requirements are clear. Someone with only a bachelors is perfectly eligible for 4011 if they have in fact performed the job duties.

No. Each application is assessed according to the eligibility requirements and caps in place at the time CIC receives it. In order to be considered for Express Entry, people will have to express interest separately (starting in January 2015) using a new electronic application management system. There will not be any application caps or occupation lists at the launch of Express Entry.

It might not be surprising, but it's also not true. Until there's a new MI.

I am stuck in a situation.

My application got back on 17th October (Returned on 2nd August). I sent it in May. My NOC is 2172 and it still has a lot of space so I wanted to apply again.
BUT I have moved to England for my Master's. I will here till September 2015. I want to apply again but my application package is back home (Pakistan) and I have a few documents with me here (bank statement etc). I am not even sure if

1. I should start from scratch with updated documents or I should use the old one?
2. Should I ask my family to apply on my behalf or shouldI apply here from England?
3. I have some documents here and some are in Pakistan. Should I even try again or not?

1. You should update your documents to there will not be a gap.
2. You have to sign the application yourself so you should do it.
3. It's up to you. If it's a worthwhile goal for you to immigrate to Canada, put in the effort.

A friend is planning to apply for express entry.... he is from NOC1112 category and hasnt applied for FSW yet .... DO you think he would need to get WES assessment done for Express Entry?

9 duties are listed as main duties for NOC 4011 including lead statement. My husband has proof that he preforms 6 of these duties. Will CIC feel he his eligible for this NOC?

They won't consider your application if it was received after the cap was filled. Your application will be automatically returned to you (they don't have any flexibility to consider your application once the cap has been filled). You can certainly submit a new application under the arranged employment stream - however you'll need an approved LMIA.
