I need your urgent response and the maximium help you can present.
i just received a letter from CIC informing me that they have refused my application .
my score was 55 and i got zero on language,as you can see from the initial correspondence i missed doing my IELTS since i saw the DECISION MADE and since then i waitied for this letter.
What I think happened in your case is that, assuming as people say, that you don't get more than 8 points, if you write a letter of proficiency, the IO thought you will not reach the minimum 67, in your case (55+8=63points), so he awarded you 0 and rejected your case- I am assuming. I do however think, for a fair assessment, you should have been given the chance to submit an IELTS exam report(unless in your documents update letter they requested for IELTS in your case), but again, it is stated categorically that
"Without taking the language test it is up to the discretion of the visa officer to award you
points for your language ability. If the documentation submitted does not establish the
claimed level of proficiency the officer is not required to request additional documents nor
will they conduct an interview to assess language ability. The immigration officer can award
points for a lower skill level and assess your case using these points."
Im graduate of USA and from an American university in Lebanon ,i have no problem in English but i need to know what to do right now and whether CIC may accept my appeal if i send them the IELTS(didnt do it till now ,will register tomorrow).
Please let me know what to do taking under consideration the letter date was 27 february 2009.
