Well i already filled my petition,simply i cant afford going back into the process one more time...if it didnt work this time i will forget about the whole immigration thing.

i guess its up to CIC to decide since im presenting good evidence of my language abilities also i will be taking the IELTS on the 19th of April and expect results end of April....

wish me luck guys,even though i feel its not gonna fly...
 
is it mandatory for CIC to reply for my appeal,i mean do they have to answer or not forced to !!! and if they are what time frame we are talking about !!!
 
Today i finalized the last part of IELTS and supposed to get the results end of the month ,i dont know whether whatever im doing is of benefit......guys help out,r they going to consider my letter !!!!
 
I got end of April my IELTS results and it was three sevens and one 6.5...my consultant send it right away to CIC london...i dont know what to expect,i need your view guys on what may happen and whether theres any opportunity to accpet it and change there decision
 
Thanks Syd....however im looking for some comfort ...i really need to know what to expect and whether i have a chance or not...shall i do something else,more then what i did so far !!!! when they may answer me either positive or negative!!! r they forced to reply or not!!!

Hope that you get a positive response from CIC London.
Just out of interest, during the first assessment, where they gave you zero for Language, Did you write any letter/essay explaining your Language proficiency or not?

Indeed there was a letter in this regard,the officer also didnt pay attnetion to any of the facts that assures my english proficency including me working for a canadian company for couple of years(outside canada)studying in the USA and other forms of evidences...

I need to know whether the information i send in addittion to IELTS reulsts r enough for them to reconsider their decision and what is really key for me is to know whether they answer me no matter what is the result or they simply can dump my request

What I think happened in your case is that, assuming as people say, that you don't get more than 8 points, if you write a letter of proficiency, the IO thought you will not reach the minimum 67, in your case (55+8=63points), so he awarded you 0 and rejected your case- I am assuming. I do however think, for a fair assessment, you should have been given the chance to submit an IELTS exam report(unless in your documents update letter they requested for IELTS in your case), but again, it is stated categorically that
"Without taking the language test it is up to the discretion of the visa officer to award you
points for your language ability. If the documentation submitted does not establish the
claimed level of proficiency the officer is not required to request additional documents nor
will they conduct an interview to assess language ability. The immigration officer can award
points for a lower skill level and assess your case using these points."


Im graduate of USA and from an American university in Lebanon ,i have no problem in English but i need to know what to do right now and whether CIC may accept my appeal if i send them the IELTS(didnt do it till now ,will register tomorrow).

Please let me know what to do taking under consideration the letter date was 27 february 2009.

I guess this is exactly what happened,and this is why i dealed with another consultant,now after i got the IELTS score,i need to know what to expect out of it and when!

My 2 cents worth:

While waiting for a reply from the initial application, Start to get ready, (assuming your occupation is one of the 38 on the Ministerial List) with an IELTS result, a new application, but before then, make sure that your calculation in worst case scenario gives you about 69 points. Whilst hoping for the best, Put in the new application if you get a negative reply.
 
sure...eventhough im a computer science graduate however my occupation doesnt fall in the 38 occupationa and therefore my options are few..
 
Guys guess what...i was just checking my E-CAS status and its back to IN PROCESS however when u press on it ,its still the same as the old message " we started processing your application on April 24,2006.

A decision has been made on your application .The offcie will contact you concerning this decision.

Can you tell me whether this is an indication that im back to the race and the letter i send to the program manager along with the IELTS results did work out,or this may be just an error!!!!!!!!
 
i faced the same scenario. i got the status of 'decision made' before being asked for medicals. for me, my case was rejected. i hope that you are lucky.
