It's not clear to me how the PR mother's children can be used by an abusive sponsor husband to force her to remain in Canada -- and in the abusive sponsor husband's house. Unless the abusive husband has adopted the children officially, he has no quasi-parental right over the children, has he? If not, then the mother could certainly take them and return to her home country.

Now, if she cannot return to her home country for other reasons, then yes, there should be some sort of efficient (lol) review board to decide whether to let her stay in Canada after leaving her sponsor-spouse.

cic should give PR to abusive mother and father will afford its responsibilities....b/c in Pakistan mostly in divorce cases father haven't afford the children expenditure....those who supports women rights they can understand these things..

My relationship is genuine and I love my husband, but I have to say I am glad I got PR before conditional visas went into effect (if they do).

This is not because my relationship is not genuine and I am not afraid of posting this on this website even knowing that some if not most people will read this thinking exactly that. That's okay, I don't care what people think because right now, for me, it doesn't matter.

The reason I am glad is because three years is a long time. It's long enough to make a life and a home for myself in a new country, to make friends and put down stakes and burn bridges in my home country. And it's long enough for a healthy, vital relationship to fall apart at the seams and come undone.

I love my husband and I intend to be with him for three years and much longer, I INTEND to be with him for the rest of my life. So many things that I intended to do with my life have not come to pass. That's this crazy little thing called life, that's how it goes.

It's nice to know that, though I don't foresee it happening, if my relationship with my husband dies that I won't be forced to stay in a loveless marriage by some government legislation. Because, in the end, that's all this legislation will do. It will force people to stay in loveless (and sometimes abusive) relationships. Because if you had the choice between staying with your husband or wife whom you have fallen out of love with, and giving up everything you've worked hard to achieve since coming to Canada and going back to a country that you no longer consider home, which would you choose?

that's so true that for so many once u arrive in Canada u will not consider home ur home country, canada is ur home, and in 2 years u can achieve so much...all that should not b erased by a gouverment decision...

no suva it's not in force yet...it might never be

suva, you seem to be in support of the legislation because one of it's supposed benefits is going to be that it will decrease wait times for "legitimate" couples. I am highly, highly skeptical of this. It just means they will have to hire staff to investigate and enforce the regulation. In reality, I think it will increase application processing times.

And even if it IS true (which I doubt), it's something that will happen gradually over time, not over night, so you likely will not see any benefits before your application is processed. I'm sorry that your application is taking so long, it's unfortunate, really. But conditional visas are not an epicure, I think it will do more harm than good.

This legislation is NOT going to decrease wait times nor was it ever intended to. It's purpose is to provide recourse for those who have "slipped through the cracks" having duped the sponsor and CIC by commiting immigration fraud by way of a marriage of conveniences.

@Iamrobot85 - the legislation is not supposed to affect those whose marriages/relationships are genuine but have broken down over the course of 2 years after landing. However, therein lies the danger. Break-ups are often ugly and if the sponsor decides to play dirty by claiming a marriage of convenience when there was really a marriage breakdown, the new PR is in jeopardy.

This legislation is fraught with dangers. They have been debated over and over again so I'm not going to do it again here. But if a person would REALLY think about all the things that could go wrong in a marriage as well as what many people DO give up to move to Canada to be with their spouses and all the things that could happen in between, they would see that this is not black and white. It has several grey areas and potential to be extremely negative. There are also positives as it may deter marriages of convenience. But it could be used very loosely as well. I would bet that this legislation WILL be enacted BUT I am hoping that the government and CIC are taking a long, hard look into how it will be administered.

Just a final thought, all the couples who think they are happily saying goodbye to this forum after receiving PR and landing in Canada will have to come back to figure out how to get conditions removed after 2 years if they land after this law comes into effect. They say removal of conditions will be "automatic" but trust me, NOTHING is automatic in immigration.

yeah i also think that processing times have nothing to do with this law...even if it will be enforced, it will still take around 20 months...look, i made a little reserach and i noticed that the embassies slow for family class r slow for other classes too, so this new regulation will not change the timings: for example, abu dhabi office takes 27 months for family, 13 months for a work permit (instead of just a few months) etc etc...this is a problem of too many applications vs a few people working, or maybe management problem...check overall ur embassy and see

politicians r very eager of everything during elections, and they will promise u the moon and the stars...they talked abt this during the election period....i don't know if it was just a game or they got negative feedback or they have more important stuff to make law than this....i just said my opinion, i really don't know what's in their schedule Lol :p

listen the 20 months u say might be 15 months or 1 year; u never know if u r part of the slow or fast applications....don't give urself headache over things u cannot change...the important is that u r getting closer and closer!!! good luck :)
