CIC Lost my documents and now my application is refused.

My husband and I applied for me to have permanent residency in Canada in October 2015. Last week we received a letter from Officer APZ/M from CPC- Mississauga stated that my application for permanent residence is refused due to the fact that CIC did not receive my documents showing that I am in a cohabiting relationship with my husband.

Back on June 3, 2016, the officer sent me an email stating that I would need to send in letters from other people that know me and my husband to be in a cohabiting relationship, as well as proof of a joint relationship such as a joint bank account. The documents would need be received by CIC within 30 days from June 3, 2016. Three letters and a joint bank account statement was sent to CPC-Mississauga in mid-June.

On September 16, 2016, Officer APZ/M sent me an email stating that my application for permanent residence has been refused due to CPC- Mississauga did not receive the documents that were requested in June.

Since the email refusing my application was sent Friday night, September 16, 2016, I had to wait until the following Monday on Sept 19, to call CIC. CIC told me to fax a letter to them stating that I had sent the documents. After a week, on Sept 26 (today) I called CIC and she, Soroya, stated that CIC would most likely not bother looking for the documents and that I should go back to my country and reapply from there. Also that inland applicants do not have a right to appeal. She sent me a link to the list of information on appealing and I do not see anywhere that I am not allowed to appeal.

I called CIC again and this time a guy, Joe, stated that my work permit is valid until it expires which is Nov, 2017, and that I am legally allowed to stay in Canada. I explained to him that I am from the US and US citizens (as well as citizens of commonwealth countries such as UK and Australia I believe) are allowed to stay in Canada as a visitor for up to 6 months. He stated that I can reapply as an inland applicant if I wish. He also stated that anything that goes with my work permit, such as my OHIP health card, would also be valid until it expires.

Joe and Soroya both stated that any documents I send in to CPC should be registered mail. Back in June I called just about every day to ensure that my documents were received. Eventually, they told me to stop calling and that if they need more documents from me they would let me know. Fast forward 3 months later and now CIC is blaming me for not using registered mail as the reason why they lost my documents. My husband and I waited almost a year and thousands of dollars spent for this application and now we have to reapply again. They said my right of permanent residence fee would be returned within six weeks. I would still need to pay the processing fee and other fees that go with the whole application process.

Has anyone experienced this before with CIC immigration losing your papers? It is very frustrating especially when we are planning a family and have to wait until after the chest xray which may be another year to have a child.

Has happened. The best you can do is go see the MP in the sponsors riding with what proof you have and hope they will reopen your application.

I have heard of it -- I cannot say that it has happened to me.

I was also told by an immigration attorney with many (30+ yrs) experience in dealing with the CIC that inland applications do in fact give up the right to an appeal. Take that for what it's worth.

The OWP does have a clause on it that it is only valid while the PR application pending. I cannot recall the exact wording at the moment, but look at the bottom where the notes are.

That said, as Sous02 stated, you can have a chat with your sponsor's MP to try to get some help -- but I wouldn't wait to do this.

You can re-apply at anytime, and if you are concerned about status, it might be worth while to flag-pole back into Canada if you are close to a land border...

Sorry to hear that. They r very rude n ur application should not be rejected only bcz of a delay in response :mad: Did u call them after sending the documents to confirm if they received it or not? I have heard that inland applicants cannot appeal.
However, i see a scope that your case file may be opened. May be u can Retrieve some record from the courier company or post service u used and prove that indeed you sent the documents. I would encourage u to contact the MP and see if thy can do some good.

Secondly, you should be able to reapply and this time send all documents through courier company. I m sure it will workout in the end. Wish u best of luck :)

Sorry to know that. The only thing I can suggest you is you always use registered post with tracking number in future. That way you will have proof about the delivery and you can refer to the tracking number for your future reference as well.

We deliver everything as PDF through Case Specific Enquiry with a note stating we are sending the original by courier. This way they have to acknowledge it twice. If they don't, we have a copy of the courier delivery receipt and the email that is generated with the Case Specific Enquiry..

Thank you for all the replies and your great ideas. I contacted a representative for the MP Raj Saini. She says she will contact CPC-Mississauga and get back to me this week.

I contacted CIC again in regards to my work permit since it does say "Pending FC APR" at the bottom left corner and the representative at CIC stated that my work permit is indeed valid until it expires Nov. 2017. I asked for something in writing and they were not able to provide it.

I will be sending things registered mail as well as Case Specific Inquiry in the future. I did use Case Specific Inquiry the last day before the documents were due stating that my only documents left for the CIC to obtain is my fingerprints which are on their way due to them having to go to the RCMP before they can be reissued to CPC-Mississauga. It should make sense to the CPC officer that had I known that they did not receive my letters and bank statement, I would have included that I still have not sent in those documents as well.

Toronto134- yes I often called them to ask if they received my letters and bank statement. They said not to call because they would let me know if they still need the documents or not which they never asked me about.

The good thing is that my work permit is still valid and my medical exam and fingerprints are valid for one year from the date I got them done which was in June so if the MP representative is not able to help me get my case reopened then worse case scenario I would need to repay the processing fee (whatever that is since CIC likes to make their website maze-like and confusing as possible) and send in all my documents again. I did call them just now and asked if I can just have my documents sent back to me so that I can send it back into them (since they prefer inconvenience and not bother retrieving the documents they have on file), the rep said that I can send in a fax requesting the documents but that it might not be likely that I would be sent back any documents. He believes it would be more convenient for me to fly back to the other country, get a local police check, fingerprints, pictures all photocopied, etc etc rather than CIC sending an envelope back. All this because someone put my papers in the wrong pile. Anyways thanks for listening.

Glad to hear the MP will look into it for you. If what they told you is correct about the work permit, then that would invalidate any of the other notes -- like not to work in the sex trade. Doesn't make any sense, but ok.

As for the fax, why can't you submit a Case Specific Enquiry to request the documents be returned to you so you can re-submit them. Although, I would wait until you have some response from the MP. If they are able to get it re-opened, the CIC will need them.

Missing documents from your other country: can you not get the documents from a Consulate?

Seeing as how ur case is delayed, as an American you should really be applying outland , as having to start over with inland again will take too long. You can always visit your husband and stick w outland

Agreed. If the OWP is in fact still valid, you would also still have status and could remain in Canada.

It has happened to me. This is what I did - I ordered GCMS notes few weeks back before I got the letter from CIC. You have 30 days to appeal from the time you receive the letter. I gathered gcms notes, fedex document stating they delivered, a letter asking them to reverse the decision, copy of email which stated that I have sent flume to... they reversed the decision on 29th day. I started with leave and judicial process on 28th day, and had to cancel it. So much beauraceatic process. And I lost some money trying to fix their mistake.

Very Well done. Good for U!!

I am positive that the MP will help u out. If it doesn't work out, try the above way. Lastly I would encourage reapplying by outland way as others have suggested. There is a guide I read yesterday about appeals. So far I didn't come across any clause about no right of appeal for inland applicants. Possibly they have reversed the rule :) Secondly there are instructions about contesting CIC's decision in court. However, I feel courts r lengthy and expensive route as u'll probably need a lawyer or legal consultation. Reapplying seems more attainable goal in short term.

People who apply inland cannot appeal. They could ask the Federal Court of Appeal to review the decision (this is not the same as an appeal). However, that would cost a lot, there is no guarantee you would win, new evidence cannot be added (that is, they will look only at the evidence the visa officer had when he or she made the decision), and you would need a lawyer.
If the MP cannot help get the case reopened, then I would just reapply, and this time outland. Your work permit is valid until the date listed on it, apparently. In any case, you can stay in Canada as a visitor while an outland application is in process.
