My husband and I applied for me to have permanent residency in Canada in October 2015. Last week we received a letter from Officer APZ/M from CPC- Mississauga stated that my application for permanent residence is refused due to the fact that CIC did not receive my documents showing that I am in a cohabiting relationship with my husband.
Back on June 3, 2016, the officer sent me an email stating that I would need to send in letters from other people that know me and my husband to be in a cohabiting relationship, as well as proof of a joint relationship such as a joint bank account. The documents would need be received by CIC within 30 days from June 3, 2016. Three letters and a joint bank account statement was sent to CPC-Mississauga in mid-June.
On September 16, 2016, Officer APZ/M sent me an email stating that my application for permanent residence has been refused due to CPC- Mississauga did not receive the documents that were requested in June.
Since the email refusing my application was sent Friday night, September 16, 2016, I had to wait until the following Monday on Sept 19, to call CIC. CIC told me to fax a letter to them stating that I had sent the documents. After a week, on Sept 26 (today) I called CIC and she, Soroya, stated that CIC would most likely not bother looking for the documents and that I should go back to my country and reapply from there. Also that inland applicants do not have a right to appeal. She sent me a link to the list of information on appealing and I do not see anywhere that I am not allowed to appeal.
I called CIC again and this time a guy, Joe, stated that my work permit is valid until it expires which is Nov, 2017, and that I am legally allowed to stay in Canada. I explained to him that I am from the US and US citizens (as well as citizens of commonwealth countries such as UK and Australia I believe) are allowed to stay in Canada as a visitor for up to 6 months. He stated that I can reapply as an inland applicant if I wish. He also stated that anything that goes with my work permit, such as my OHIP health card, would also be valid until it expires.
Joe and Soroya both stated that any documents I send in to CPC should be registered mail. Back in June I called just about every day to ensure that my documents were received. Eventually, they told me to stop calling and that if they need more documents from me they would let me know. Fast forward 3 months later and now CIC is blaming me for not using registered mail as the reason why they lost my documents. My husband and I waited almost a year and thousands of dollars spent for this application and now we have to reapply again. They said my right of permanent residence fee would be returned within six weeks. I would still need to pay the processing fee and other fees that go with the whole application process.
Has anyone experienced this before with CIC immigration losing your papers? It is very frustrating especially when we are planning a family and have to wait until after the chest xray which may be another year to have a child.
