Children sponsoring their mother for PR in Canada!

My children (Permanent Residents) asked me that they want to sponsor me for PR. I am a filipina who is based in UAE from the last 20+ yrs. While the children sponsor me and I give my papers for submission, will my common law sponsor will automatically be eligible to get PR or my common law has to wait until I get my PR so I can sponsor him? I and him already traveled to Canada together and were asked from border security officer about our relationship as we quoted us common law partners while applying for our TRVs. I will appreciate for your valuable opinion. Thanks and looking forward to hear from you.

Your common-law partner MUST be included in the application. He will be counted in family size for income requirements, and he'll need to pass medical and police checks. You can get PR status together if app is approved.

Does at least 1 of your children have the necessary 3 years of Canadian minimum income to qualify to sponsor you?
And did they submit a lottery form of intent to sponsor you last month? If not they will need to wait until next year.
Only 1 child can actually sponsor you.

In order to know minimum income needed for past 3 years you would need to advise the family details of your child i.e. do they have a spouse or kids?

No, you must declare all details about your common-law partner in the application. This can't be skipped. As I said regardless if he intends to come to Canada now or not, he must be included in family size for income calcs, and must pass medical exam. So whatever child sponsors you, will 100% know you have a common-law partner while doing the app.

And you cannot hide your common-law partner from immigration. It's misrepresentation and is very serious.

Rob, I appreciate your prompt reply. As I don't want my children to know now now though later they will definitely know it. I registered a company here from last 3yrs and my common law partner is managing it as General Manager/In charge. Is there any possibility that we apply by our self and on what base we should apply to get it done quick as soon as possible? We both have valid TRVs till next year so if there is anything you can suggest us, we will be glad to know your possible advise.

Dear YVR123, I don't like to hide anything from the immigration and want to be truthful but I can't tell my children now about it. That's what I am thinking and thanks for your reminder. I appreciate.

If you want to apply for PR independently, you'll need to see if you qualify for any current immigration programs. You can research them all here: https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada.html

Realistically though if both of you are older (in 50s and above), you may find it impossible to qualify for any immigration program independently. Parents sponsorship may be your only chance.

you MUST tell your children and include it in the application. If you do not you will Never be able to sponsor your common law spouse and if found out you risk your possible PR status.

Just checking that you realize you have been living with your partner for at least 1 year continuously to claim common law. How do none of your children realize that you have been living with someone for at least a year? I also don't understand why you started a company (name only) in Canada.

We are living together from 2yrs and my children never know as they don't live here with us. They came once to visit me in UAE and that time he was visiting his country. So they don't know till today and when we went to Canada together .. we didn't stay with the children but in a hotel and I used to go and meet my children and spend some time with them and then come back in evenings and sometimes when I had to stay with my children in Evenings ... he understands so he stayed in the hotel. So my children never know about it. That's the truth. Well about the company I registered is in UAE not in Canada. I hope it's clear now and if not then please don't hesitate to ask and might I find a nice solution for my immigration.

Your options have already been explained:

- tell your children and be sponsored along with your partner
- don't tell them, be sponsored, commit immigration fraud by hiding your partner, come to Canada alone and never be able to sponsor your partner
- attempt immigration through an economic stream (unlikely given your probable age)
