I'm talking about few years back because this thing happened to one guy whom I knew. But I don't know the process at present time.

Hi BloomingFlower Sister...Sorry to Hear abt that trouble..but this might help you....get a good immigration lawyer from desi news paper and inshallah this matter will be resolved within months not a year...the lawyer fees maybe alot but trust me its worth paying every penny of it ..so you can be out this problem very soon and also...keep praying inshallah everything will be fine...Again "Dua say barh Kar duniya mein koi haal nahi hameray problems ka"....so Dawa n Dua dono karey...inshallah Allah Tallah aap ki madat kareingay....and you will be out of this mess very quick...Ameen

beacause the warrant can be dropped if the lawyer appeals to immigration court thats its a Human Error just make sure you have the documents that were given to you husband and photo copies of the boarding passes/ticket etc....to proof that applicant (your husband) is not a defaultor...and they know proper format of a appeal and they know the exact words to play with...(they know the law more than we think..)

BloomingFlower, I really feel for your current situation. May Allah make things easy for you as a single mother. Ameen.

I agree with Armaan's post, getting a decent lawyer, but make sure they are not just about the money, and make him/her go fight your case. They made you wait for this long, and your case can be resolved if handled by a smart lawyer. They made a mistake and make them take responsibility for it.

Other than that, I think you should talk to your employer about your situation and explain that they made a mess out of your application to sponsor your husband. Your kids haven't seen their father and you have to go because you are all alone here. Even if it is an unpaid break, go for some time and be with your husband. This way the kids can see their father and you won't have to feel alone and depressed. Just being there will help you and help your husband emotionally.

I pray that Inshallah, things will be sorted out. Good Luck and do feel down, Inshallah Allah is watching and he will guide us.

they asked simple questions like what is your childrens bday?
when did you come to canada?
how do you like canada? what do you like about the city you lived in?
why did you come back?
when did you get married?

it was in english the interview and she was a ghori i think there were 2 of em....

my husband then said that he applied for refugee claim but took the claim back in an interview with a immg officer just a few day befo we got married in april of 2005 and the officer said to fill out an application for withdrawal "notice of no intention" and he has to leave within 15 days....nothin about giving proof..and that how can i be a fugitive when just last yr you guys requested a rcmp police clearance and i have provided you with that ..how can i get a police clearance with that warrant in my name.....she didnt have an answer

well my husband didnt have a passport and so he traveled on a traveling doc and so he left within the time frame and the traveling document and proof of ticket and boarding pass is with the embass giveing them proof that he did leave the country when he was suppose to ...so the immg officer wrongfullly send out a warrant for his arrest and any other doc that they did send didnt apply to him coz me and him was not in the country we went to pak for our valima.....

so...now they will contact the imm judge to start a correspondence with him....

I am so sorry to hear that sister. I think you need to stay on top of that with ur MP and see if you can get the record from the immigration office there in canada where he left from too. If you get hold of that THAT WUD BE AWESOME. then u can mail it to CHC-ISB.

Inshah ALLAH ur wait will end soon INSHAH ALLAH dont worry.
Sometimes they need just SOMETHING to grab so they can save themselves. Because if they ignore it then its their A** on the line. Unfortunately we cant even blame them .

Its all about not keeping things straight when he or whoever shud have kept it straight.

MAY ALLAH EASE your pain .

Not sure why they ignored your wifes file after the Re-medical. Did your wife send them the slip from the Re-medical ?

Sorry about this result on your interview! This is the last thing anyone wants after having to wait so long. It is up to a visa officer's discretion to ask for ARC or allow it without one. I guess his visa officer wants to see the ARC. As far as I know ARC application takes about a year for them to approve or deny it.

Do you know if the refused the case or if they will keep it open until your ARC application is decided? Either way you will need to get the best lawyer for this. IF refused then appeal as it seems like you have good case if you have strong evidence that he met the officer before he left and informed them. You can ask your lawyer to request the judge that the queue of the application be kept where it is instead of putting you at the back of the files when appeal is allowed ( I have seen some cases on canlli.org where they did it to save time for more wait in queues after the appeal is allowed).

It takes about a year for the full hearing after the appeal anyway so hopefully by that time you will have a positive decision on your ARC application (in sha Allah).

Here are the things they take into account for ARC apps:
-Your reason for returning to Canada?
-Why were you ordered to be removed? ( Exclusion or deportation order)
-What silly advice did you take?
-Are you sorry for your actions?
-What degree of responsibility you are willing to accept?
-How long did you drag out the process of your removal? ( after order was issued for you to leave)
-Did you leave Canada at your own expense?
-Did you make the Canadian government pay for your flight?

inshaAllah you will win the appeal! Be strong sister this time will pass too!

Thanks everyone. It was a very simple and straight forward case, no complications or interview, except that it was my second marriage after I went through divorce in 2003. My wife did not send the receipt of the second medical to CHC ISB though. When it was send finally, she got the letter for PPR just one day after.
Nevertheless, I am very happy and hoping that the visa is stamped ASAP. I have already advised my younger brother in Lahore to tentatively reserve a ticket for her in the last week of december 2011.
