Are chat logs mandatory? My fiancée and I always just sent texts. Never emailed or anything or sent letters.

I unfortunately haven't kept the texts and neither has she. We do have a lot of pictures together though. Will this be enough? She is coming from the USA.

You need pictures (20 pics), and you also need proof of an ongoing relationship which implies ongoing communication for the full time you've been in a relationship.

IRCC is looking for you to prove your relationship, and the documentary evidence in the form of chat logs, or confirmation of texts through phone bills or logs from sms applications.

It's up to you to provide strong and convincing proof of your relationship. You can sponsor your finance after you're married as a Spousal Sponsorship, or, as commonlaw IF you have very clear proof that you've lived together for one year (uninterrupted).

No, not mandatory. It is just one of the suggestions for what you can send. You must be able to show some texts and call logs. If you aren't living together, communication proofs are required.

The guidelines for the new application say 20 pictures.
If you have cards, like birthday cards which you've sent to each other,
or emails, those would help.

It's up to you what you include in your application. We can only tell you what we've found IRCC has often / usually expected.
And you said she's your fiance. As I said, unless you get legally married, OR can prove that you've lived together continuously for one
year which is the requirement for an application as Common Law Spouse, then you don't meet the Canadian legal definition for 'Spousal Sponsorship'.

If you sent your application in after you married, then the burdon of proof WRT conjugal relations does go down.

What's the plan? To marry and wait for I
PR? Or are you planning to live together while they process your application?

We are going to get married and apply Outland. She is going to stay with me as much as she can until she can legally live here.

Each has it's own quarks and evidence suggestions.

Inland, for example, doesn't require you to prove that you talk, because you're to be living together. But they will require proof that you're finances are intertwined. So showing her a user on a cell bill, for example.

Outland they have traditionally asked for chat logs, social media chat, phone bills with records that you call each other, etc.

They have also said that there isn't supposed to be a deference to inland or outland any more. That the promised processing times are 12 months for either. Given that the promise was delivered in December, that's yet to be seen.

Also, keep in mind that, traditionally Can/Us couples generally have a lower proof threshold.

With that in mind, I am curious why outland vs. Inland? If they request an interview, she'd have to return to the US to be interviewed.

When we started the process, we chose based on being able to spend the time together, and on my wife's ability to work and stabilize her life in Canada. That made the choice easy for us.

She wants to be able to go home and visit her family, which if you apply inland I have been told you cannot leave Canada.

Can they visit here?

While it's true you shouldn't leave, the reasons are because the CBSA could refuse re-entry. If she wasn't able to return, then it could find her application abandoned. It is totally up to the officer you get.

That said, lots of people do in fact leave and return, they report no problems. You can verse her on dual intent, so she can prove that she has a PR application in, and that she has significant ties to the US. So that way, they are satisfied she will return home if rejected. The OWP also strengthens the case that she plans to abide by Canadian law.

Just food for thought..

I see where you are coming from. They live in southern Delaware and I live in Kingston Ontario so I don't think they will want to do the drive a lot. Her working while she stays here is not a big deal. Part of why she wants to apply outland is so she can go home and work every once in a while as well during the summer months (big money bar tending in ocean city Maryland). I think she feels safer applying Outland and traveling back and forth because if you get denied entry while waiting Outland your application is not abandoned.

Just because you're denied once doesn't mean she can't try again. The risk is pretty low that they would even question the entry. But spending more than a couple weeks would be a problem.

I was merely playing devil's advocate. It would work to reduce the proof burdon, but it's not for everyone. That's why I asked.

I usually go down there for a month in the summer. We are going to have a lot of pictures from our wedding and we have lots of pics from different vacations we have been on. We are going to try and dig up some old chat logs. Even showing contact on a phone bill is hard because we have done everything on FaceTime for iPhones so it's all done over data lol
