Bring Thai girlfriend to Canada on TRV then marry then PR ; questions

Hello,

As the topic says, I have a Thai girlfriend residing in Thailand. We plan to apply for TRV for Canada, get married inland here and apply for PR inland so we get to be together while we wait for the answer.

I understand the difficulties with getting the TRV approved and that she needs to give good enough reasons for her to come back to Thailand after her visit. So my questions are regarding the best way of proceeding to acquire the TRV.

My girlfriend has a steady job in Thailand she sells villas and condos and makes a decent salary and her boss is able to sign a paper stipulating she will come back to work.
I myself will be writing a letter of invitation.
One more thing I'm hoping will work in our favour is that she has a son in Thailand but he is completely under the father's custody.

What is the paper her boss would sign for her called ? Will that really help us get her TRV ?
Should we declare to the office about her son ? Would that be considered a good point for her to return to Thailand because she needs to see her son ?
Does she have to go to Bangkok to do the TRV papers or can she just do them online or by mail or through a local office in her city (Phuket) ?
Any advice on my letter of invitation ? (do it properly, what's expected to be there and what's good and what's bad to put on it)
Is there anything else you guys think I should be aware of before doing the process ?
And last if you guys have any recommendations on my situation or additional tips on how to be successful with her TRV application, we would be very grateful.

Thank you!!
-Julien

i am guessing a "letter of employment" is needed from her employer. this will state how long she's been with the company and her salary information. I'm sure they can add something about them expecting her to return at the end of her visit.

I would also guess adding information about her son being in thailand would be a considerable plus for showing ties. Even though the husband has custody, does she have visitation rights? Perhaps including the son's birth certificate and custody papers will help? *Technically* in order for her/you to sponsor him in the future (if that's part of your plan), the father will need to give permission, so I would assume showing the current custody agreement will help her obtain a TRV and intentions to return.

*This is just an opinion based on what i've read on these forums, so hopefully others with children and from that area can provide more detail.

We do not plan on bringing her kid with us, but we want to mention it to the officer for the TRV to better her chances at getting the admission. She does have visitation rights.
I'm wondering what are the odds of her getting her TRV with her job and her son, and if there is anything else I'm not thinking about so I can do this perfrectly.
Thank you.

Based on our own personal experience from only 1 application (we invited my wife's sister), with the same job, who had more children, AND a husband to return to and got denied, and denied rather quickly I might add. We submitted it all online. We did not use an agency.

Does she own any land? Is there an 'agency' there that you could use? They think of things not "spelled out" in the list of requirements.

Now, I understand that when it comes to parents & grandparents, it's a bit easier to get a TRV. Nonetheless, when it came time to invite my wife's Mom we used an agency, who didn't submit it online, and was approved in less than a week.

Having said all of that, what's your "plan B"? (You don't have to post it here, just suggesting you might want to start thinking about that.)

Having a child in Thailand will not help her chances of getting a TRV
We applied twice with no luck and then once sponsor was approved we applied again with Dual Intent and in a week we had the TRV

Let me know if you would like more information

Cheers

@cdnmom
When you say once the sponsor was approved, is that the PR or just them approving you as a sponsor ?
Would you suggest getting married first then apply for sponsor/PR then apply for TRV. Our biggest issue is we have to wait for the process and be apart, as long as we can wait together we'll be happy, and this as to be done in Canada. Can you explain dual intent to me ?

@truesmile
Would an agency really boost our chances of success ? What things being not spelled out would they be thinking about ? I'm trying to figure out what to tell and not tell them when applying for TRV.

I don't know how much a successful Thailand application will differ from Philippines, but I have NO regrets over using an agency. Could we still have been successful? Maybe. But we sure wouldn't have included everything that we did if the agency hadn't told us to do so.

For a TRV:

Is the inviting party currently living and working/studying in Canada? If yes, do not bother writing a letter of invitation (unless there is no attraction between the parties and it's more like a business invitation). Just have the invitee apply on the strength of his or her application without an invitation. The inviting party could still help the invitee by, say, writing a letter of invitation to support the invitee getting prior travel experience to a THIRD country that neither party is working or living in (the inviter cannot easily overstay in that third country then, so the invitee can't either). The inviting party might also be able to give the invitee's financial capacity a bit of a boost by supplying enough periodic cash over several months to reduce the invitee's need to withdraw salary from his or her bank account. The extra growth in savings would look good.

If the inviting party if currently living and working/studying in the invitee's country, an invitation letter is advisable IF it can be shown that the inviting party has a good expat position to return to after a trip to Canada with the invitee. In this case, you see, the attraction is pulling the invitee away from Canada at the end of the planned trip.

Thus, the ideal sort of situation would be like this:
- You, the Canadian, go to her country to work or study. You begin to help her a bit with some undeposited cash so that she doesn't draw down her bank account as much for living expenses (however she still draws it down some, it should be plausible frugality on her part)
- On the strength of your financial ability to support her in a tour through, say, the USA, you help get her a US B2 visa with an invitation letter (this assumes you don't have property and ongoing income opportunities in the States that would give her a place and a reason to overstay in the US)
- with the US visa in hand, and you still in her country, she applies for her Canadian TRV. You fully intend to accompany her throughout her visit to Canada including, and especially, her return to her country. You will return as well to your attractive expat position as well, you see.
- Having taken a trip to the US and to Canada and returned to her home country, you now apply for the multientry TRV unless you already have it so you are good for the next good while
- You now start her PR application. Where you each are located no longer matters much.
