Hi,

I applied for PR last September, and I got an email in August which says that my application has been refused because I did not obtain the required language score (WHICH IS NOT TRUE!!!).

The email says that I am required to have CLBs of at least 7 for NOC 0 or A occupations. But, the point is that I applied with NOC B occupation!!

For the recent two weeks, I sent email three times which explains my NOC category and asks for reviewing my file again, but no response yet.

I'm totally panic now. If there is anyone who has a similar experience with me, could you share it, please? In addition, could you guys give me some advice what I should do?

Sorry to hear about that..

So in last 11 months ,there was no communication between CIC and you ...

I would suggest you to contact good Immigration lawyer so that he can prepare a professional response for you .....and follow up your case
on ur behalf.
 
Did you had 2 jobs in which one of them is NOC A?. If that's the case You should apply for NOC A i guess(I am not sure but i read this some where in this forum).

No, I had only one job which is NOC B. Anyway thank you for your reply.

If I were in your position, I would simply reapply.

Btw, what was your NOC code?
 
Did they concur with the NOC level B occupation you specified for that job?

Or did they decide your job duties actually belonged to some higher-skilled occupation (NOC 0 or A)?

Ideally, while generating AOR, they will check for the IELTS score and NOC. Since, you got your AOR you have passed that criteria for sure and hence have a strong case to appeal for reconsidering your application.
 
^ They didn't always check language results at CIO. That only started in November (OB 554).

I didn't know that. Thanks LPS. I have a checklist from CIC which includes all the probable reasons for applications being returned by CIC. (I got one of the application returned due to some missing information and it has that list).Do you have any idea how to attach picture or paste here so that it may be useful to all.

What is your NOC code you applied with and what is your english score?

what's your job letter, do you mention code directly ? and your duties, are you sure is right, or other place you mention duties is wrong like in offer letter, work permit ?


Generally, I don't think CIC officer will make such mistake and don't give you a reply after you query .

something others maybe you left mention here .

Another weird thing is , why your application take so long time? lots of request in this year is done . you can check Feb 2014 or Jan 2014 .

I don't think there exists something special in my application, but the email in August was the first and last contact from CIC..

could you post the email here ?

it is really not right for the CIC to object case like this, if everything is right.

your work permit is NOC B or NOC A
