Based on my experience it’s hard for them to hide behind this issue. The process is based on common law and past cases. If IRCC has processed cases in order they could use this argument but based on many atip notes they have processed randomly. While they are processing jan/feb 2021 many 2018 and 2020 are waiting for test invites, so the ground for mandamus strong. Based on my experience even court does not accept delay in security screening by csis and cbsa as a reasonable for delay in processing applications. What happens when you file the mandamus, IRCC process tour case urgently. I believe I saw this in one of the OPs.
Again the real issue is not a backlog the issue is random processing of application. I believe this is even a serious matter as “negligence”.
But for order of processing issue, would it be a general lawsuit instead of mandamus?
Yes, order of processing resolves most issues for us.

Yes, that’s why I suggested to seek a class action as this is a negligence case it will be much cheaper rather than individual mandamus but we need a focused group to do the follow ups which is difficult to mange to have one. But if someone wants to pay more the individual mandamus is an option.

Honestly, you should absolutely NOT interpret general advertising text on a lawyer's website to conclude that 'many law firms recommend mandamus.'

As my bolding and underlining above may show, this language is very broad and in no way constitutes a recommendation or specific advice, let alone anything actionable or indicative of likely positive results.

This is just general introductory advertising. A duct-cleaning firm will probably have text that says "having your ducts cleaned may resolve problems with your furnace and air conditioning"; doesn't mean it will work or is worth the expense in your situation.

so what should we do just sit and wait ?
 
Met with a lawyer today.
He is experienced in Mandamus and says that usually they expidite the application with just a letter from the lawyer stating the intent of filing the Mandamus. He told me to ask my MP to request for an update and then we will go from there. He has filled Mandamus before and said he has never had to go to court because they don’t want to waste time + money of going to court.
He is charging to write the letter but let’s see how it goes from here!
 
Do you have a list of all applicants from all cities to prove that 2021 applications across all cities are being selected before 2019? There are 100k+ applications so some posts on a forum could be irregularities and not a trend. There are delays throughout all immigration programs. A global pandemic creates delays. Yes people are legally able to leave and get citizenship. I think that’s a crazy concept but I also can see that a large number of the people complaining are people who have left Canada or who are planning on leaving Canada. I don’t see people being honest about why they want their citizenship ASAP. They either want to leave ASAP or have left and are now worried about tmeetimg their PR RO to qualify for citizenship.
There are cases like mine where my PR cards have now expired and reapply wouldn’t make sense because it will also take just as much time. Due to them being expired I am not able to renew my ID’s and not able to travel for emergencies let alone for leisure. Not everyone is in a hurry to leave the country. I pay my taxes went to school here and have been working in this country for the last 7 years. You do not have to assume someone’s reasons. Everyone has their own personal struggles and reasons and whatever they may be they are all valid.

anyone tried to contact a lawyer with multiple applicants? I'd like to send the same letter but $1200 seems steep... I wonder what if several applicants go together then the cost is $200-500 which is not too bad

This isn’t unexpected. IRCC clearly have the capability to expedite an application and will probably only refuse to if they are severe delays outside of their direct control (security screening). It makes no sense to fight all mandamus cases, may as well just settle when a lawyer gets involved.

Hey, I have been waiting since April 2019. No test. The only thing that's complete is the background check. Please don't give me the pandemic excuse. There's only one reason and that's ineptitude and lack of foresight on the part of IRCC management. It's evident from the document obtained. and they are worried about legal consequences too. I am not going to quote the document. I am tired of doing this, to be honest. but they mention legal consequences in the document.

Please don't tell me I have to be fine with it and wait even if it's going to take another year or two. Enough is enough. There's a purpose for mandamus, and based on what I have read, it's absolutely relevant in cases like mine. People like me or @Zoomer, we have been waiting for 2.5 years almost. I don't appreciate your condescending tone. People have different reasons. for example, if I get my Canadian citizenship, I will be able to travel for my job much more easily. I would be able to attend seminars and conferences. I won't have to apply for visas 6 months or one year in advance. It will improve my life and brings utility to the entity I work for.
 
Am tired of this. Anyone here started petitions? We need a clear backlog from all paper based applications, enough is enough. Covid is not an excuse anymore. We are as vulnerable as other applicants. People are getting citizenship who applied February 2021. Meanwhile 2018-2019 application are stale.
