Yes. Try doing the CELPIP right away! It's much easier. You still have time to apply. We should have about 200 spots still opened. Try to re-apply before September, lots of people will become eligible by then.
If Dany1982 decides to reapply, then it's probably a good idea to also include his rejection email. If Ottawa is consistent in assigning points, then he should be FOR SURE eligible after improving his language by 2 more points, even IF he reapplies using the EXACT same supporting documents as before (though it's probably still a good idea to also include more details and responsibilities in the reference letters this time). That way, we can tell if Ottawa really was just looking for an excuse to reject applications, or if their reason was truly legit.

Hi Dany1982, I'm sorry to hear that, and it's obviously a bad news for a lot of people (including me that would only have at best 68 points without those 5 adaptability points). At least for you, we know that they (Ottawa) recognized at least 3 years of your work experience, and theoretically speaking, if you improved your IELTS scores by at least 2 more points, then there should be no reason whatsoever for them (both the CIO and Ottawa) to reject you, if you reapply using exactly the same work experience. This is probably something that you would want to consider.
Hi Guys,
It is a bad news. I guess they are counting work experience as TA/RA but not counting it in adaptability! For adaptability, does it need to be one year full time work experience not equivalent one year ??

The thing is, for adaptability, I think the work experience needs to be obtained using a work permit. RA/TA work experience most likely is obtained with study permit, so that's probably why they won't award these previous Canadian work experience points.

I can ask for a better work experience letter from my previous employer, I had 4 years of work experience in my hometown country which they did not count

@ Dani: sorry to hear that. I guess that I'll hear back from them very soon too.

For any of us who have to depend on those 5 adaptability points, we should try our best to increase our points. Retake IELTTS/CELPIP, reinforce proofs for work experience, or even get married.

Hi Guys
It seems that Ottawa has a different interpretation from this 5 points of adaptability, they send a reply to my email and again saying the same thing and confirm the rejection. this is their reply :

You were provided with the decision containing the reasons for refusal of this application in our message thereby fully concluding this application. I note that you did not complete a program of study in Canada as you are currently enrolled in the same course of study for which your current study permit was issued.

Okay, I think this is the end :(
I'm so sorry to hear that...This is very frustrating....If Ottawa does not award the 5 points, should they at least synchronize with Sydney? If people are rejected at the CIO, at least they can get their money back....It's wrong that they charged you and gave you hope and then rejected you simply because the two offices interpreted the clause differently...It's not fair!!

that is just sad... but I had a feeling from the beginning that the adaptability points are awarded only when someone completes a degree. Well, don't loose hope. Sit for IELTS and apply again...

I'm so sorry to hear this Dani1982..i also think you should retake the IELTS and reapply as soon as possible...now i'm curious to know whether this will be the same response to those who actually got an NER overturned to PER by the CIO on grounds of the 5 adaptability points..? :(

I want to hear from other applicants soon. It is really taking a while for them to communicate with January applicants!
From the 50 original applicants until Jan 20th,( the first update on January 2012 up from the 37 by end of December), we have a sample of about 25, so we can predict pretty much what is happening. No more than 5-6 guys got medical requests so far for sure.

I think the response from Phdapplicant's case can give us more info about how Ottawa thinks.

Hi Phdapplicant, I am sorry to bug u at this time.

I just wonder how detailed you wrote on your letter of reference from ur past foreign employment.

Did u also provide some other documents like pay slips, contract or...?

Best luck in appealing your case.

According to the note in Oversea Processing (OP), OP 6 - Federal Skilled Workers (version: 2011-06-17):
Section 7.2 Assessing applications against the Ministerial Instructions issued June 26, 2010
“Anticipated short breaks between jobs are acceptable. For example, if an applicant is employed in one occupation for a 4 month contract and before the end of that contract, has secured other employment that will begin shortly after the end of first contract, this break in continuity would be acceptable.”

I have summer break twoo, and I got PER.
Hi. But how can I actually prove that my employment was secured? And what do they mean by short breaks? Is 4 months is short enough? :)

Hi Moonbow2010, for the letter, I followed the same format described in the Checklist IMM5483. Especially, I wrote every details about my job duties to closely match their job description (even though I rephrased the wording instead of using their word). Besides, I also provided my pay slips, contract, and tax forms. Hope it help.
