canadianwoman, I was closely following this thread and although you knew the appeal went bad, I really hoped that you get a positive decision.

I'm so sorry for your loss, I pray that you stay strong and patient.

So my answer, tgchi, is not everyone would want to return... me included.
As so there may also be the additional consideration of inland and outland. And is the outland applicant living inland. Damn Souxie, this can get too complicated.

I think this whole borders thing - imaginary lines - has somewhat become BS. When I get State-side; considered the most difficult immigration to consider; I'll let you know.

Take my own case, for example. I have been in Canada for nearly 10 years
Do you think that is fair?
And no Siouxie, I don't think that is fair but how many applicants have been in Canada and involved in the community and family as you have for 10 years and then either turn away, or are turned away, by their spouse?

Canadianwoman - I wish I could bring you some words of comfort. You have brought tears to my eyes, and I wish there was something I could do. I hope you and your husband continue to fight for your love and that somewhere, somehow you two can be together the way you should be.

WHAT THE ____ i thought you had this in the bag.I thought even though the appeal did not go as well as you thought, i thought for sure you had it knowing how long you two have known eachother.I am so sorry for your loss of your mom.I cant imagine what you are going through. My heart breaks for you girl. This is so upsetting it leaves us speechless.
Well there is only one thing for you to do now reapply, knowing what you know now and all you been through it should go through better.Dont let them bring you down stand your ground girl and try again, unless anyone else can think of a way or to do it different.
I dont think anyone can go over the judges decision but that doesnt mean there isnt. This is where i would get everyone i can involved.Write a letter to the Prime Ministers office, your MP,the news, everyone. You didnt back down from them before dont do it now.
If there is anything you need >>>>>

Thank you everyone for your kind words.

I guess we will reapply, though I don't know how often someone gets accepted the second time round when they've lost an appeal.
You can appeal the appeal decision by taking it to the Federal Court, but while the appeal is supposed to be based on the facts, the Federal Court judge just reviews the appeal decision to see if it was reasonable given the evidence submitted - in other words, the Federal Court judge might think the marriage is real, and yet if he also thinks the appeal decision was reasonable, he can't overturn it. Plus I do not have enough money for the lawyer fees (I don't think so, anyway; I haven't actually asked her what they would be yet).
Anyway, I will think about what to do; right now is not a good time to make decisions.

Immigration is a very emotionally draining experience to be in under the best of circumstances. But you have had to go through alot and just need time to give your mind some rest. Think of your health. If you can, pamper yourself a little with massage therapy. Your mind and body will thank you for it. I am really sorry you have had to go through so much needlessly. hugs

Relax and regroup and then make decisions. As my husband said to me; this may not turn out exactly as we always dreamed, but we will be together and we will be happy.

I remember when we got our refusal letter. The refusal letter had things that were not true in them and I just couldnt believe what I was reading. My husband and I were in a state of shock. We have a pretty good feeling we would be refused but the refusal points were crazy. My brain was mush for some time. Then I got mad and my husband and I promised each other that we were going to fight until we were together. We didnt have a choice which country since I have kids, but if I was not having little ones I would have moved there with your even batting an eyelash. Let me tell you its BEEN and still IS a fight just for us to get this far. We decided and made a promise to each other long time ago, that we would never dismount unless the horse was dead. LOL.

I pray for you and hope that some way a door will open that will give you what you deserve. hugs. You will get through this even though it doesnt seem it right now. You will be together just might not be as easy as you had hoped, but it will happen.

I am so sorry this has happened........and like others, I have no answers but to say....you will be together some day.

A love like you and your husband have, will eventually overcome all this.

canadianwoman, I am so sorry! I was sure that you would get approved. Can you move to be with your husband and then reapply?

Yes, that is what I will probably do. I came back to Canada to look after my mother when she got very sick, and then my dad got sick as well, which is why I didn't go live with my husband earlier. Now I guess we will find some other way to take care of my father, and I'll go live with my husband.

You are facing some tough decisions. I don't envy you, but wish you all the best. I hope this long journey you have been on ends in happiness.

My condolences to your family Canadian.

I don't have words to describe how saddened I am by this decision. Wish I could give you a hug to comfort you and help take your mind off some stress.

I really hope and pray that you only find good in your relationship and please do keep fighting it with CIC.

Is this the end of it all or do you have another appeal you can go through?

God, I wonder why CIC can be such beatches about applicants and their spouses.

Best of luck to you love and please don't ever give it. Keep fighting it!
