Thank God the journey is finally over. You will hear from VFS Lagos from Monday. If you live in Lagos, go to their office and pick up your passport, but if you live outside Lagos or Abuja, they will send your passport between Monday and Tuesday and you will then receive on Wednesday or Thursday as in the case of my wife.

Thank you my brother, God will be with you, you said it earlier and now its come to pass Hallelujah

Judicial review only considers whether IRCC/IRB made a decision valid in law. Personal hardship, separation, medical issue, etc aren’t part of the process. Generally they don’t allow new evidence about your case. Given your application was refused and you had your appeal dismissed, a JR will likely be difficult to achieve a positive result.
So how long did you know each other before you were married? And when was the last time you were together. I’m assuming, since you haven’t clarified, IRCC feels you married to prevent her deportation.

It is next to impossible to get a positive outcome from a JR. One reason for this is that there is NO requirement for the adjudicator to be impartial. This person can behave in whatever way he or she wants and can make a decision solely on his or her perspective. So most decisions do not contravene any law. Better to not waste your money on a lawyer for a JR but work on a plan to reapply with a better application.

Good evening beautiful people I have a quick question for y’all and would like to share if anyone here has an idea about it? I have not seen anyone on this forum got refused of their Appeals here but was told when your appeal is refused, you can’t appeal again and would like to know how true it is and if anyone has any idea about the next line of action to take when ones appeal is refused?

Most people who lose their appeal are devastated. We lost our appeal and our Judicial Review. There is no further recourse except for you and your spouse to address the issues raised in the application and appeal. Then reapply. Sometimes there is nothing you can do. But if you show that you tried, your application might be considered. But it still may be turned down eventually again. At any time, any application can be stopped for 1} suspicion of fraud as determined in an interview where you may be asked a lot of paranoid questions that make no sense 2} failing the medical - Class C score 3} failing the security check. The system is rigged against us, particularly if you are poor, unemployed or West African. The Ghana office has the highest rate of declining applications - 40%.

Can anyone help me applied for my wife got denied went IAD appeal got allowed appeal its almost three month after apeal allowed no response can anyone tell me how long take after apeal allowed
It can take up to one year to get a hearing. You will be contacted to file paperwork. Get yourself ready to be asked a lot of private private questions. Like about your sex life, your religion, your finances. You would do well to get a lawyer. It may cost much more than $4k. We paid $8k and lost anyway.

Hi all. Am really nervous. My husband was refused in may. We filled the appeal end of may. My lawyer told me a week ago that we have been approved for an ADR by the end if November. Pls has anyone gone for an ADR and won? What should I expect from an ADR

Expect a lot of really personal questions. Family and extended family questions. Religion, Sex, Finances. They will not spare you any dignity. Remember this is NOT an impartial hearing. The Adjudicator is hired by Immigration.

Unfortunately i do not have the money to do that. Did you ever get a procedural fairness letter?

While it is best to hire a lawyer, you do not have to do that to file an appeal. However, you must be prepared to get all your proof together and represent yourself.

what kind of questions do they ask and how much time it took?

They will ask you about children, religion, sex, family, extended family, work, finances. There is no dignity there. Expect to be mocked, derided by the immigration lawyer for CID and also by the adjudicator who has no legal requirement to be impartial. Our hearing was one day, rushed and 3 hours long for each of us. Our lawyer charged us $8k and we lost.

Hello Guys my full hearing is coming up and I’ll like to seek for more ideas about how the process goes and any tips on questions I should expect? Every piece of advice will be appreciated and what is the success rate of appeal cases?

We were asked the following questions:

1. When did you first have sex?
2. What kind of birth control did you use on that occasion?
3. What kind of birth control do you use now? Why?
4. How much money do you the sponsor send your spouse? Why? Did you do this before you got married?
5. Who brought up the idea of getting married first?
6. Why did you marry your unemployed boyfriend?
7. Why didn't you get married in a church. Who else in your family got married in a church?
8. How did your father immigrate to England? Was he there illegally?

And many many more. Be prepared to be humiliated, belittled, mocked. Do not be fooled. This is not a law informed hearing despite the presence of lawyers. There is no requirement for the adjudicator to be impartial. We brought legal precedent and were told it was not relevant.

This whole process is inhumane, first they took 16 months to refuse our application and after winning appeal its been almost 6 months and they are still assessing application. I can name at least couple of applications which are completely fraud but their visas were approved in a 12-14 months. So their assessment is complete bullshit.

Hey at least your MP did something. None the less I agree. The whole thing is bullshit. Thankfully you won the appeal. Sadly they can still reject your application on other ground EVEN THOUGH YOU WON THE APPEAL. Like health, security etc.

That does sound strange, but they cannot turn you down for non-genuine marriage again. At this stage, they can only turn you down for failed background check/security, or misrepresentation.

Sorry but I'm not sure that's entirely correct. If you fail the initial application process, then you fail the appeal (usually for the same reasons) then it is likely you will fail the JR. Once you apply again, you are more likely to fail again unless you have addressed CIC issues with the first application. At any time you can be turned down for health, security or other.
