I wasn't talking about someone who was going for JR. I was talking about someone who won their appeal. If you win your appeal when you were turned down for non-genuine marriage they cannot refuse you for non-genuine marriage again. Of course, they can still refuse you for failed medical, failed security/background check or misrepresentation, as I said in the post.Sorry but I'm not sure that's entirely correct. If you fail the initial application process, then you fail the appeal (usually for the same reasons) then it is likely you will fail the JR. Once you apply again, you are more likely to fail again unless you have addressed CIC issues with the first application. At any time you can be turned down for health, security or other.
