did you receive confirmation of your appeal from them ?
depends on city you appealed :)

Hi everyone
It's been a while since I've been in here. My husband visa was refused back in January. I filed for appeal and just received my blue book. Since the rejection, I've been living with my husband in his country for 3 months and now were in italy until august. Then I come home to Canada to wait. I sent a letter to the appeal board that I will be living with my husband until august.

Here's my question.. Now that I've received the blue book, how long will it take to know if I'm going to get ADR or full hearing? (Toronto)

We were denied because they think our marriage isn't genuine, because we don t speak the same language (although my husband can understand my English and we can communicate just fine). They say our marriage was haste but we were married a year and a half after we met. I am ten years older than him, but they didn't put that as a reason for denial. Also that we have different backgrounds( i don't really know what that means other than we come from different countries, but doesn't everyone here applying?). Also my husband doesn't have much work experience and it's doubtful he'll get a job in Canada. He has worked, he works hard, but not a legit job like we have in Canada. Just for cash or farming in his town. He did manage a hotel in Greece for many years but because it was illegal, the owner won't give him a reference.

Based on that, do you think we have a chance to get ADR? If we don't do you think we could be successful in reapplying?

Thank you all

Hi,

My husband was denied with same reason marriage not genuine.
He has similar situation related to work issue.
My lawyer sad that if reason for denial is marriage not genuine, they shouldnt question his work.
I had ADR in may, i was asked only to describe how our relationship developed. We had travelled a lot and also the whole time i was staying in his country. Yes, he asked me where money came from and i sad my husband deals with cars. It is not official work. Officer didnt ask more about work so i didnt have to explain.
I won ADR. I would recommend to think about some good explanation re his work, but again it shouldnt be reason for denial since you are the sponsor.

hope it helps,
regards

What happens after I get my blue book? Just wait to hear if I get ADR or full hearing? How long does that usually take? I'm in toronto.

Thanks again :)

Hi everyone ..My husband was refused a visa so we appealed and now I received a letter with a date for a appointment in Vancouver with the Immigration and Refugee board at the IAD ,its not the full hearing but a informal hearing to discussed in an informal way to increase the fairness and efficiency of the hearing of the appeal. The will also discuses the number of witnesses I plan on calling at the hearing ..provide more documents if I have..try to agree on the issues and facts that are relevant to the appeal and discusses the date for the hearing..Im little worried ..Is this a good or bad thing?

Hi again!!
When are you going for your meeting??? I have been thinking about you guys and all of us from that dreaded May 28th day.....

after blue book you just wait. if you granted adr they should notify within 4-5 months, if not it will be full hearing. usually you should be done with adr within6-7 months after blue book. for full hearing takes about year. Do you have lawyer? At first I was given full hearing even though we had a child born but then they reconsidered. My lawyer actually did a great job. Im talking about Toronto office as well.
If you have other questions will be happy to help.

Unfortunately I can't afford a lawyer. All my money has been spent to be with my husband. I really hope I can get ADR. if not I might take my chances to just reapply. I don't know. This whole process has just been so draining. I don't know I have it in me to do the whole application again.

We had to wait 28 months from filing appeal to Hearing date. Vancouver is much shorter time. They will tell you 12-18 months but this is not true !

Please help me. I received refusal letter and its indicate. Marriage is not geniun or reason of the marriage is immigrant to Canada.

Now I want to appeal. My friend suggested me to recieve a blue book first, then after hire a lawyer if I needed.
Please if you can advise me the process of Appeal and where I can find the appeal form.
Thank you.

my adr went smooth so lawyer didnt play any role in it, BUT if not my lawyer i was gonna get full hearing. Also officer was very glad to see that my husband helping me financilly (i provided western union transfers from husband). blue book should has all red flags that officer had during the interview. In my blue book there were lots of stuff that my husb never sad, and it was totally redicilous. Btw you did a right thing to live with your husb,it will definitely help you.

I heard from them 6 months after winning appeal. I bet you will hear this month !!!!. In my case- appeal was August 2012. E-cas changed end of January 2013. Asked for documents beginning of April 2013

You can try to speak to MP. They can find out whats happening.

Yes i did go with me same .. interview etc etc . But i didnt get ur point about Nikah nama.plz mention in detail .

Salam, the first Nikah Signer was not registered as a Lawyer to sign so our marriage was not registered in March2010. CIC gave us a chance to correct this which we did.
Now they said it maybe a Marriage Fraud and not once have they contacted the Union Council and new Nikah signer. Although I`m registered with NARDA as his dependant along with his place of Employment.

We contacted the Union Council and the new Nikah register and they told us they have not been contacted.

I pray they ask for his Pass Port and Police Clearance his medical expired Jan 30/14 but the Visa Officer can extend this to 18 months which would expire July 30/14. I just hope and pray that approve all our info its 46 months were waiting and the second Visa Officer in Dec/13 was satisfied it was a Genuine Relationship I pray the have the same opinion In Sha Allah. May Allah help us all In Sha Allah.....
