Married: December 28/11
Filed sponsorship: March 2013
Interview/Decision Made - November 21/13
Received Denial notification - December 20th/13

Blue Book Rec'd: May 2014.

My husband was denied based on 3 reasons. The first is that they think we married too soon after meeting (we met in July 2010, engaged March 2011, married December 28th 2011 - which to me does not seem like a short time. After this we did not file our sponsorship for 2 years), that we do not share a common language (I am Chilean/Canadian and my husband is Cuban. We both speak Spanish.. and he studied English for 3 years..), and that my husband was not employed (he was asked to leave his job as he was a professor. They felt that he could not teach in a socialist setting being married to someone of a country that does not agree in that ruling).

I'm just curious to what is the next steps after the Blue Book has been received. How long until I know what will come next (or an estimate)? If an ADR or full hearing is asked, is it possible to win without a lawyer? Of course I have considered/wanted to hire a lawyer... However being the sole income does put a strain on my pocket book.

If I could get some feedback, opinions, and what to look forward to, I would be so greatly appreciative.

Hey sorry about your refusal. To me, your engagement and marriage doesn't seem like a rushed affair at all. When you guys first met, were you in a relationship at the time? You can order GCMS notes to see the detailed explanations for your refusal and red flags, maybe they indicated more than you were led to believe. It sounds very strange, but I know that they consider it a red flag if a couple waits too long to file a sponsorship application, don't really know why, it would seem like it should be the opposite because they're not in a rush to get PR.

Anyone know how long it will take for the Record book to arrive? My appeal was filed on March 3, 2014, and still hasn't arrived. :(
 
I read it too and it's just strange. The both speak Spanish, or do they mean English or French as a common language? As for why it's a red flag if the couple waits too long to file, based on CanLii cases I've read, CIC believes any normal couple will want to be together as soon as possible, so delaying it implies(from their perspective) that the couple is not in a rush to be living together. It's really a matter of how an individual officer interprets it which is something I dislike about this particular process.

That said, the question would be whether the OP explained the reason for the delay in filing or not. It is likely to come up during the appeal, so would be good for them to have an answer.

120 days max it's a law
 
Just wanted everyone to know I Won my appeal!!!!

I appealed September 2012
ADR was refused and went to full hearing and won in June 2014!!!
Now for the final process :)))
Can't wait until this is over!!

July 3, 2014 going to be 120 days, and still my record book hasn't arrived. What will happen if over that many days?

Congrats on winning your appeal. Could you please shed some light why your adr was refused and what to expect at full hearing. Did you appeal in toronto or somewhere else. Who was your ministers counsel at hearing. Thank you....awaiting for your reply7

Congrats ankit...... could please shed some light regarding timelines on your case. Did get adr or full hearing. What did they ask in interview. Who was your mc at hearing. Thank you
 
My husband got denied in 2012 and we apply for an appeal in May,2012 and i have receive the blue in sep,2012 from since then i haven't hear no hearing date or nothing right now its been 2 year plus more of waiting. How long it take to get a hearing date?
