Bill C-6, current status, FACTS only

Since people doubted I had a high-level friend at IRCC, and told me I didn't know what I was talking about when I said the revocation proceeding amendment was unconstitutional... Well... You're hearing it here first. The Conservatives will introduce another amendment today RE: allowing minors...

    Bill C-6: Senate stage

That's a good one hahahahaha. Yeah. The Liberals fault. Buddy, if the Conservatives had won the election this bill would never have even seen the light of day, and we wouldn't even be having this discussion. You're frustrated, I get that, but it's not the Liberal's fault. They sped it...

    Bill C-6: Senate stage

Just speculation, but I bet the Conservative senators just delay, delay, delay until Justin Trudeau prorogues Parliament and shuffles his cabinet this summer. All bills die then, so you have to start the whole process over again. Most Prime Ministers do this half-way through their term, and...

    Bill C-6: Senate stage

Can you please provide a link for this story? I can't find it on the CP website or on Google News...

    Bill C-6: Senate stage

Re-read it. The minister is only able to not proceed on cases if they are satisfied that sufficient humanitarian grounds exist, or to revoke if they are unable to find the person in the world. Only the court will have the authority to revoke someone's citizenship. So, therefore, if the...

    Bill C-6: Senate stage

You have to go. There's no legislative mechanism in that amendment allowing someone not to. That's why it's flawed. The Minister can only choose to not proceed. Only the court can revoke someone's citizenship under this model. Re-read it if you don't believe me.

How to Submit Use of a Representative Form

You can just complete it and mail it to your local office if it's been forwarded there from Sydney, or else you can send it to Sydney.

    Bill C-6: Senate stage

I am absolutely all-in favour of some form of doing revocations better, but this is a total windfall for the lawyer-lobby, and forces people to take their cases to court when they might not want to or be able to afford it. It's for the rich.

    Bill C-6: Senate stage

(3.1) The person may, within 60 days after the day on which the notice is received, (a) make written representations with respect to the matters set out in the notice, including any humanitarian and compassionate considerations — such as the best interests of a child directly affected — that...

    Bill C-6: Senate stage

That makes sense. At least they won't throw the baby out with the bath water if they disapprove of the amendment in the House.

    Bill C-6: Senate stage

It is being challenged in court. See Monla vs. Minister of CIC

    Bill C-6: Senate stage

No it wasn't. It was prepared by a law clerk at the Senate. She testified to that herself when it was introduced. The department had no idea of what was coming.

    Bill C-6: Senate stage

Exactly. The Minister won't want to be locked into this very, very prescriptive method of revocation. There are other methods IRCC would prefer to use.

    Bill C-6: Senate stage

I agree. It will pass the Senate. Absolutely. But the House will not pass it with the amendment as drafted. That's when we get a stalemate.

    Bill C-6: Senate stage

I have very high-level friends at IRCC. We'll see who's wrong in a couple of months. The ugly truth is the Federal Court can't handle the extra work and nobody wants a process that drags for years. Some of the amendment is unconstitutional as well, according to IRCC's lawyers.

    Bill C-6: Senate stage

They said they were in favour of some elements of improving the process. Not the complete overhaul that was just voted on.

    Bill C-6: Senate stage

It'll never happen. The minister has already spoken against the amendments. There won't be anything quick about this at all.

    Bill C-6: Senate stage

If you all think the Minister and IRCC is going to let this one slide you re daydreaming. If they were cool with revocation stuff they would have let it pass the first time in the House when it was debated there. It'll get stuck in limbo between the two houses forever now.

In fact, there was an Oath ceremony in Kenora at a hockey fame just last week. A special one for Canada 150. I read about it in the paper.

Oh man, I grew up in Dryden. I didn't think anyone ever immigrated there lol. Your office will likely be Sudbury, but my understanding is they do itinerant services up to the North once or twice a year. They'll do your test, document verification interview and your oath all in one day. I...
