Hoping someone can help with some guidance as we still have not heard from IRCC.
My spouse has a son in the US. His ex partner said she was going to get a passport & medical exam done and has since changed her mind and filed for full custody instead. She said she will only do a medical & passport if my spouse gives her full custody & she will give visitation rights. We are so lost on what to do and every lawyer we have spoken to suggests we need to work something out with her because this could make IRCC refuse the whole application. We have a new born daughter and we really don’t want to have the application refused. If my spouse and his ex agree to some sort of parenting agreement that gives her full legal and physical custody, will his son still require a medical exam? Is he still considered a dependent at that point?
