H&C Humanitarian Ground with/or Without Failed refugee claim

Hi Guys, I submitted H&C application in May 2020 and received AOR August 2020, went in process November 2020. my application is based on the interest of the children, establishment and hardship in home country, my family is outside Canada, i submitted H&C application for myself alone due to insufficient fund at that time. my question is: i would like to know if its possible to put in my families application now as mine is already in process, or should i wait until mine is approve then put in sponsorship for them.?

That's why I have a lawyer.

Yes, we have such sentence in our letter too, I am sure these letters are more or less standard. But I haven't read about such case on this forum in the last year at least.

Yeah, this is what we have been doing once I learned it hard way. Everyone on this forum in the past was convinced and convinced me that we have zero chance to win, so I did not even bother about small things like proof of address. Of course, for younger people who established their lives here, it sounds odd.

Hi there, I hope you have a lawyer helping you with this.Your family should’ve been included in your application at the time you submitted your H&C. I hope you atleast stated you had children outside Canada so when you decide to put in your sponsorship it won’t seem like you misrepresented .Since they were not included,you will need to put in sponsorship for them.

Hi, I do not have a Lawyer on this.. i had a very bad experience with two different lawyers during my refugee claim proceedings.. can i still put in their application? or would that delay the on going process?

you can try with legal help ( even if private lawyers are better...) or you can look here for a good lawyer according to members experiences... can you give us some informations about your case if you want ?

She received the COPR after 27 months of waiting. It was beyond rough period, but I am very grateful for that approval. Good luck to you too!

Yes i mentioned their names our family photos, my children Birth certificates and copies of all their documents and my wife's own.. but i didn't do their pepper work and fees.. Thank you so much for your quick response.. God bless

I know there’s a form where you could add family members at some point. I’m not sure they still do that.Did you not include your family at all when you put in your application?

According to my lawyer, its better to join in the application just people present in Canada even if some family members abroad can be included, and about sponsorship (soupses and children under 22) after PR i think strongly that its a right... for Permanente residents and canadians... so its not misrepresentation

Since you mentioned them at the time of your application,you can still do their paperwork.I believe this is stage 2 of H&C where you’d provide all documents required.I hope you now have the financial means to bring them here
