Possible to waive medical exam for non-accompanying dependent?

I am facing same issue with my spousal application I applied my husband in March 2017, since that all the steps are completed however he had two kids from his previous marriage. His ex is not supporting her to let kids go under medical exam and now we are stuck application processing time is over long time ago. We already submit a letter to explain our situation that we can not provide children medical exams as she is refusing but we do not have written proof as she is sending verbal messages through relatives. My husband already accept and request in the letter that he won’t apply his children in the future. I don’t know immigration are not responding is it has been two months already we sent them this letter. Anybody aware how long they take and what else I should do? What options I have now. I am very worried and disappointed by the situation I am facing .. please help it has almost 2 in half years I am waiting for my husband ..

Under what category did you apply for the PR? I am also in the same situation but I have applied under express entry- FSW. I have completed 6 months. I have read in this forum that cases like ours have no fixed timelines. Some gets clear in a year and some can take indefinite time. Looking at your case now even I doubt that my case can also take more than a year.

Hay I sponsored my husband from Pakistan as a spousal sponsorship. He had dependent from his previous marriage and they are living full time with their mom.

So dear after the LOE you have waited 6 months? We already sent a letter but now we are going to send affidavit to immigration very soon, but I am very worried about it it’s already late 6 months after the normal processing time. They haven’t replied any of our inquiry or letter.

I am really scared after looking at these posts. I have sent affidevit when was requested for medical. No reply yet! I ordered my GCMS notes which shows it’s under SDS review. Anyone have any idea what it means ? What is SDS?

Yes, right. We sended Affidavit, LOE and all proofs that we can not get husband's son and his medical the same day as med.exam of my husband. After that we waited about 6 months to final decision.

And did u hear back from IRCC on yr affidevit, as it’s over 6 months now!

I just received PR without having a medical completed for a non-accompanying dependant.

It did not delay my application at all. I received PR 5 months after initially submitting my application to CIC.

All I had to include was the custody agreement stating that my ex has full custody, I only have rights to visitation as seen appropriate by my ex, and a signed statutory declaration stating that I understood that by my child not completing the medical they would be forever excluded from family class sponsorship and I would never be able to sponsor her.

I submitted the statutory declaration and custody agreement with the initial application and was never asked anything more about it.

My husband is PA from India and we had already sent application and didn’t pay fee for non-accompanying depentdents. We already have attached custody explaining divorce agreement. Do you think this is enough if not then please reply soon

Yes just a letter. As i donot have custody i donot have a custody doc.

If yes then in when did they apply and after how many months or days did they receive their PR and what all they did to justify not submitting dependent medical. IRCC have to agree with the decision to remove an individual from the medical examination requirement. It's not automatic, just because you send a "declaration".
