Out of status- CBSA visit. Exclusion order..help!!

So my husband got an exclusion order issued as of January 8 2019. The Minister's delegate did state there will be a follow up removal interview in the coming weeks/months. We still have no AOR. And based on what the CBSA officer said the final desion is ultimately up the CBSA officer who will conduct the exclusion/removal interview.

We have no choice but to wait and see what the outcome is of this interview, Hopefully with some luck our AOR comes soon and with that we can have some leeway with the officer.

We are praying for favorable outcome.

I don't think the AOR matters at all on their decision, what I was told is IF I get AIP they would leave me alone until IRCC has a decision on my application. But I am still waiting, it's been almost 11 months since my CBSA interview.

No I haven't bothered to, because our application was recvied December 11 2018, I know we wont get AOR at least tell February 2019.

You are right. They are still sending AOR for November's app.

Are you worried for this long delay? I am inquiring because I am sponsoring my husband who is out of status and filled out a PRRA that was rejected last month in which he now has an Exclusion order on file. The CBSA officer 2 days ago from our call-in meeting is willing to wait for the sponsorship app to be completed. We submitted inland in March 2018. I am hoping we will hear a decision made by December 2018 as Jan 2018 apps are being approved now. Hearing that you are in your 16 month is concerning me...

From my understanding if he was issued a warrant for arrest he has received a deportation order. If I am right and he is being deported he is becoming inadmissible to re-enter Canada (when deported a person is banned from Canada permanently). In order to apply for the sponsorship outland he needs to apply to an Authorization to Return to Canada (ARC) and convince the immigration officer that he deserves to be back.

I know that what was done its done, but just in case someone is in a similar situation of being caught by the CBSA before applying for the sponsorship (and CBSA does not give the person a chance to send the application prior to the exclusion order is issued) and is reading this thread... The best option is to leave the country and apply outland before getting a deportation order.

Yes but they are different stages of deportation. My understanding is if he was issued a exclusion order he is banned for 1 year and can still come back before 1 year if he applies for an ARC. That's what the cbsa officer told us. Hoping this is true, just spoke to the lawyer and he said that's as well.

Sorry, when I answered you I meant to answer a post before yours... the person who is being deported. Your case is exclusion order and indeed if your husband leaves you can apply for an outland application and after 1 year he is good to come back. I really hope thar he will not need to leave.

Yea he will need to, but such is life. Good thing is he will be able to come back. Should I start the filing now or wait for one year

The CBSA out of status interview is set for January 8 2019...The CBSA officer has been very kind us so far, even when the discovered my spouse was here out of status in Canada, there was no arrest, no bond, only monthly reporting and they where very nice to us. We where honest about everything in terms of out of status and provided all information to them.

We will take the proof that we have sent our application in. The good thing is that my spouse has a lot of family in Canada (legal citizens) as well my spouse visited Canada when he was a child. So there is a lot go genuine family ties, history and memories in Canada. Hoping we can overcome this hurdle as a couple. I really feel for couple out their going through the same thing as us.

I know CBSA are not here to keep people, rather they're job quite simply is to send people back to their native countries. My spouse has been reporting to the CBSA since August of 2018. Unfortunately it took us months to gather our file for Inland Sponsorship but it has been sent as of December 2018.

We have been given a lot of misleading information about CBSA interview, We have been told if you do not have AOR, CBSA can provide an exclusion order therefore nullifying the Inland sponsorship and my spouse we would be sent back to his native country.

However I have been also told even no AOR has been received, as long as you can show proof that an application as been sent, The CBSA officer has the option to let you wait for a few more weeks etc.

Not sure how this all will turn out next week, but we are staying and thinking positive, I hope the officer can see we are good people, and a young couple just starting our lives.

what proof of evidence you submitted if he is out od status? i have friend out of status he will pass his application this month but he's proof of cohabition is not enough no rental agreement no joint account no address

We met with him originally 10 months ago. Ever since our app has been going ok so far. We did finally get the prra interview letter the other day and are to attend in mississauga on Sat. But the officer we have been dealing with here in our hometown told us just the other day ( hubby consulted with him when he went to sign in) and he told him not to worry. They will most likely wait for a decision. And if not, ask for deferal. Worse case, if we were forced to do prra, last option, we should still b ok since app is almost finished with. I know our situation seems a bit different but just putting it out there that hubby WAS given exclusion order before app was submitted. Officer did not stall on that. He stalled on submitting to mississauga office to buy us time. ( i just feel that part of ur message was directed at my situation so thought id chime in lol. If it wasnt, my apologies lol)

Same here my hubby was give exclusion order before our application was sent in, he will be returning home since we are no where near completing the application, I will go visit him, it's a stiff price to pay, but I understand as he is out of status. Am grateful that he is able to come back after all this is said and done. Cbsa has been good to us thus far. Am just really sad he has to leave, hopefully your interview on the 8 went well and he gets to stay while its processing. He can continue to sign in and stuff while the application is going through.

It was not directed to you. Sometimes people use the wrong term and make others confused. My message actually was to the one who said that her husband was refused humanitary, then stopped signing in with cbsa, then cbsa is sending him back home.... of course I understood that he is being deported and not only holds an exclusion order. Got it?? I dont even know anymore whose case was that I would need to read all posts again. Sometimes I dont see the username only the text. Maybe it was indeed for the right person.. she said "they are sending him back" it wasnt clear to me... sorry. As I said, from my understanding (and I can be wrong), when cbsa has to send the person back instead of the person leaving voluntarily after the exclusion order it is a deportation. Please someone corrects me if I am wrong.
