I am planning to marry my same-sex spouse in Mexico as they were refused a visitor visa to come to Canada some years ago to visit before we got engaged. I would like to know the following:
1. We are submitting another Visitor Visa to Canada in hope to avoid the expense of traveling to another country (he is in Latin America) to get married legally here in Canada. We will state this explicitly in the letter of intent and a signed affidavit by a lawyer here that he will return to his country where same-sex marriage is not legal to start the Outland Canadian process. We are hoping this will succeed but like the others have said - visitor visa's have been denied for lesser reasons.
2. If we do have to go the marriage route - then we will need to know what the requirements are for a legal certification of a Marriage Certificate as Canada is not part of the Hague convention.
I want to know if the orginial marriage certificate is apostilled (needed for his country to validate our marriage should they ever legalize same sex) will we need the original without an apostille or is a copy translated into English without apostille (official copy not photocopy) ok to work for the Outland Spousal sponsorship? (<-- this part affects hetro couples too I imagine)
