SCLPC Open Work permit

My wife came inside canada in VISITOR VISA..

Now she got her open work permit under SCLPC Class..

In the work permit it clearly says that "This does not authorize re entry"

Does I need to change her status. by applying for new visa.. What kind of application does I need to make.

a work permit allows her to stay in Canada for the duration of the permit it does not allow to to exit and re enter as she pleases.

If she is from a visa exempt country she enters on her passport
if she requires a visa to enter she must allow for that separately. (this is known as a temporary resident visa and this is attached to her passport)

Got few question still, I hope people here won't get tired of answering.


My trv will expire on June 26. I applied for visa extension for change of status yesterday. We are gathering documents/ requirements for in Canada application for my pr thru my husband's sponsorship.

Questions:

1. How long it will take me to get a reply from my visa extension as tourist?
2. Should I include an open work permit application with my pr application? I noticed that the form is just the same for my visa extension application.
3. Will the open work permit application be additional fee on top of pr app fee?
4. Should I get a medical done to include in my pr application?

Thank you so much.

1. Unknown. I'll defer to others.
2. Yes, if you are submitting an Inland application. Even though you can submit an Outland application while you are IN Canada (which is usually faster for most people), an OWP is N/A.
3. Yes, $255 total ($155 + $100)
4. Yes, if submitting Outland. Inland applicants can wait for CIC to request the medical, which would be ~ 16 months after submitting the application, based on current processing times.

Hi, A Open Work Permit is not the same thing as a visa.
The work permit allows one to work for the time stated on the permit.
However the person also needs a valid visa to be in the country, if not from a visa-exempt country.

Therefore the work permit states that this document does not authorize re-entry, because that's what the visa is for. In the end it will depend on the CBSA border agent to let you in again or not, if you decide to leave the country, which is not without risk for inland applicants.

When an inland applicant is denied re-entry the inland application for permanent residence will be considered abandoned and you would need to go through the process all over again from the start. Also at that point since the decision will be made to reject the application from that point on the open work permit will also not be valid anymore.

So if your wife is from a country that needs a visa, I suggest her to apply for a visa as well for the duration of her open work permit just to be safe. That way if she needs to leave the country before the entire process is over, she has the best chances to re-enter Canada at that point.

Thank you for sharing your experience.

I need more info on this case as I have a similar case.

My wife had a visitor visa before our marriage and I applied for a Spousal application for PR when she was outside of Canada.

Currently, she is in Canada with me on a visitor status and I would like to apply for an open work permit.

Can you please tell me will i need to apply online or paper file and can I apply?
