Conversion of evisa to oci in India

Hi Prashanth

Thanks for sharing the information. My wife has some similar situation and should get her visa conversion done in India. Please suggest or give some info if you know answers for the below questions.

Our Current Situation:- My wife citizenship oath is on Oct 23rd. And she has to travel to India between Nov 15th to Nov 20th and stay there for an year atleast due to some situations.

Thinking of the below plan:-
1. After oath, get Canada passport, Apply for Indian e-visa and travel to India in Nov with Canada and Indian passports.
2. Surrender the Indian passport in India. (Thinking of this because she can't get the surrender certificate in Canada before she leave to India. And it's quicker process in India).
3. After getting the surrender certificate, apply for Entry visa through e-FRRO portal.
4. Stay 6 months with entry visa and apply for OCI.

Do you think of any complications in the above plan?

Questions about your case:-

1. Just wanted to know, why did they fined you with 23k INR?
2. Any idea about the processing time for conversion of e-visa to entry visa?
Fine is generally collected if you travel on your Indian passport after getting citizenship of another country. Also there is time frame within which you need to surrender your passport. The time limit and fine available online does not seem to be the latest version.

OCI rule says you can't apply from within India if you're on a short term visa. Not sure if this has changed or if it is not enforced.

I live and work in India. I have come to Canada to finish Citizenship and OCI process. Now, it's been a week since OCI application and have received acknowledgement on 11th Oct.

Now, I fear that OCI will be delayed due to Canada-India diplomatic issues.

Couple of questions:

1. Is there a thing called 'Stay Visa'?
2. Can I visit India on eVisa then apply 'Stay Visa' ?
3. Can I work on Stay Visa?

While On stay Visa, I hope to finish OCI and get a friend to deliver to me in India.

Other than employment visa/ OCI you won't be able to work in India legally. In your case you should apply e-visa and wait for OCI. Once you get it exit and re-enter India.

Would appreciate if you can update with your status, if you were to surrender your passport in india and if you were able to transfer your evisa to x1 entry visa? And if yes, did you face any difficulties and anything you would like to share about it? Thanks!

Update:

I applied for Exit permit and it got approved. Just a recap: my wife (Indian passport) and baby (CA citizen)(entered on etourist visa) on Aug 2024, however I got the physical OCI after they travelled. Then I took the physical oci and flew to India. I did not do any concersion as I was told to get exit permit. My baby 180 stay got over on Feb 6, 2025. But I applied for exit permit on Jan end stating that we are only leaving on March 2025 with a valid reason (vaccination), exit permit approved. We are planning to fly from india in march 2025. Hopefully there should be no issues. Application for Exit permit via Frro website is fully online, no need to visit office and process is easy. Hope this helps.

But doesn't kids are exempted from FRRO registration? FRRO website says "Children below the age of 12 years are exempted from FRRO/FRO registration." I'm in the same boat as my kid entered on e-visa and not sure how to convert it to OCI? Planning to stay for more than 6 months. Any inputs is appreciated.

I think that statement only means they are exempted from registration process in frro website. I think foriengers have to register themselves like where they stay, where they would travel as part of registration in frro, I think below 12 is not needed, but I recommend you to submit an application in frro for your kid, as my 1 year old daughter application got approved. If below 12 were exempted from APPLICATION process, then I would have been notified in my application process, but instead it will was processed and approved. So in your case, I would suggest you to apply for exit permit if you plan to overstay for like a month or so and then you can apply for oci while in or once you are back in canada. Since I haven't done the conversion in India, I’m not the best person to answer. But I see there is an option in frro website as visa conversion.
