We got our Canadian PRs in 2015 through Canadian experience class and then we left Canada for a job opportunity in middle east. In 2016, our child was born in middle east. Now we are planning to return to Canada end of this year.

I am trying to figure out which visa should I apply for the child and how? Can I apply PR from outside Canada or do I need to return to Canada to apply for the child's PR? What is the process to apply PR for a child like this?

What are the other options.

We would like to go and live together as a family. Please advise.

As a PR, you must reside in Canada in order to sponsor your child. You may start by familiarizing yourself through this Basic Guide: http://www.cic.gc.ca/english/information/applications/guides/5525ETOC.asp

Thanks for your response but as stated I am not in Canada. Currently overseas, we plan to return to Canada together.

What are my other options if I have to take my child along?

Can I apply Temporary Resident Visa?

Since the child was not born in Canada you or your wife will have to sponsor him. As a permanent resident, in order to qualify as a sponsor you have to be living in Canada.

I see no possible solution where you would be able to travel back to Canada with your child, unless you get a visitor visa for him. That poses other problems because the number one reason for visitor visas to be denied is that immigrations are not convinced that the visitor will leave the country once the visitor visa expires. Maybe you could apply for a visa for him on a humanitarian basis, as you can't leave your child behind.

I strongly advise you to seek the council of an immigration lawyer.

PR holders are not allowed to live out of Canada beyond certain time
You need to maintain Canadian residency to be able to keep your PR status
check the rules carefully
Your best option is to keep the child with one parent and the other parent return to Canada and apply for permanent residency status for the child.

Thanks. I am aware regarding the PR rules and I have valid PR for another 3 years.

Leaving child behind with one parent is a problem for us. I have following questions:

If one parent travels, how long will it take to get PR for child?

Do you know of any lawyer I can approach to get my child visitor visa?

How long it takes to get a visitor visa and for how long it is valid for? I mean if I get one now, will it be valid for 6 months for me to enter Canada?

What is the child's country of citizenship?

Having a lawyer won't really make a difference in getting a TRV. If the TRV is refused, apply for a TRP, Temporary Resident Permit. If that is also refused, then you have no other option but for one parent to return to Canada and remain there until the PR app is processed.

It can take weeks or months for a TRV to be processed. There is no set validity.
