Hey Guys,

I had a question concerning our application. My wife is currently studying in Ireland on a Student Permit. But she is Indian Citizen by birth. She finished her medicals in Ireland and we have highlighted London as the processing office. As it's closest to her current residence. Who do you think will process our application. Anyone know the flow of processing logic for this case? Any comments would be appreciated.

Just an update about myself. I am currently holding PR along with Indian citizenship living in Ontario. Does that make any difference where the processing takes place for Spousal Sponsorship?

I doubt my present location makes any difference.

I just heard from one of the senior member in a forum with similar scenario like what you have.
Applicant lives in country x for 12 yrs
Applicant holds passport of country y

When they applied they chose the visa office of country x where the applicant lived for 12 yrs.
but after the sponsor was approved their file was transferred to country y as the applicant was the passport holder of that country.

You have to note no matter wat was chosen as the VO by the applicant and sponsor that was overruled and sent to a different VO of CIC choice which made sense to them

Thanks for the response. Does that mean the processing time for my application would follow India's time frame instead of London's.

What about the medical results. Are they mailed to Mississauga office or the local consulate indicated on the forms upon submission.

Another concern would be, what if they ask her to submit her passport before the processing of her file has started. Which is a common case for India. My wife has exams in summer so she might not be able to leave the country. I understand International mailing of passports might not be the right option. Is it alright for a Consulate to Ask and mail it back to her current residence in Ireland from India.

There are rules you must follow as to what visa office is selected for an outland application. Basically you can choose either:
- the office where applicant holds citizenship/passport from
- the office where applicant has been living as a resident for minimum 1 year

So if she has been living in Ireland for school for 1 year, only then can she choose London as VO. Else she will need to go through New Delhi as India resident.

What about the medical results. Are they mailed to Mississauga office or the local consulate indicated on the forms upon submission.
All medicals are sent to the central medical processing centre in Ottawa, no matter where the VO is. I beleive everything is done electronically, so nothing is actually sent by snail-mail to the VOs for medicals. With the medical form/reference number the doctor gives you after the exam and that you will include in your application, a VO in any country in the world can simply access the medicals from Ottawa.

The medicals going to a central location makes sense. I am glad it won't complicate the processing if my applications gets forwarded to a different VO. :)

That would make sense but now we are seeing a different issue on the February 2013 board. The applicant lived in Cairo for 12 years but was a passport holder of Somalia. They put Cairo on their application for the VO. The application was then forwarded to Nairobi instead of Cairo by CIC. So it would seem there is more to it than having lived in the country for a year or more. Seems there is no rhyme or reason to the process.

Choose the visa office you would prefer, as long as the applicant is eligible to be processed there. It sounds like your wife could choose London or New Delhi. Just be prepared that CIC or the visa officer might decide the application should be processed at the other one.

Has anyone else other than Kuudir2 experienced this type of surprise transfer on this board.

Hi Aldagr813,

My husband has been living in Egypt for over 10 years now, and we sent in the application with Cairo as our VO.

I got an email from them today with my SA and a change of VO's from Cairo to Nairobi.

I have spoken to my husband about it, and he has never seen this before. Many of his Somali friends have been sponsored from Cairo... We both haven't seen anything like this before.

All the files have already been sent to Nairobi.

This is most likely an isolated case where the VO at CPC-M simply made a mistake. In the majority of cases, the application should be sent to the visa office the applicant specifies (assuming they qualify).

Perhaps it's good to explain in a cover letter the visa office selected, and why they are selecting it. Especially if it's different from their citizenship/passport country.

My wife lives in Kenya. I had selected Nairobi as her visa office. File was transferred to New Delhi

Overall maybe not a bad things because Nairobi timeline is a lot longer though normal cases seem to go a lot faster than stated on the cic site. My wife has lived in Nairobi for 15 years so I dont know how isolate kuudirs case is
