Hello, Im getting ready with the whole application process but Im not sure which package I should use.
On CIC's website it says the following as step one:

If your spouse or partner lives with you in Canada, use the Application for Permanent Residence in Canada—Spouse or Common-Law Partner.
OR,
If your spouse, partner or dependent child lives outside Canada, use the Application to Sponsor a Member of the Family Class.

Heres a brief explanation of my situation, my spouse entered Canada with me as a visitor for 6 months, and now since were here we are starting the application process. She does live with me (obviously) while we are here in Canada, though im still confused if option 1 would be the appropriate package to fill out, since she entered as a visitor.

Thanks, I tried to keep this as brief and simple as possible, if anymore info is required please let me know, & thanks for the help :p

I suggest reading this: http://www.canadavisa.com/canada-immigration-discussion-board/spousal-sponsorship-t46995.0.html then decide if you want to apply inland or outland. You can apply outland while your spouse is a visitor in Canada.

Im familiar with inland vs outland and am leaning towards the inland application package at the moment.

Is that what the two options are? 1st being the inland application and the second being outland?

Thanks

Yes, it's quite confusing, but here we use the terminology "inland" and "outland" but CIC says Inside Canada and Outside Canada, though you can apply outside Canada while your spouse is living in Canada 8).

Mind if I ask what country your spouse is from? Some outland VO's have very fast processing times, and inland sponsorship is often much longer.

I know the draw of the OWP but you have to weigh that with the value of the processing times. Also, with inland, your spouse must maintain legal status in Canada before applying for the OWP or it will be rejected.

Yes, it s exactly what it is. We sent our outland package to Missisauga while I was in Canada on visitor visa. It didn't matter, my application is currently being processed in VO assigned for my country of residence.

My spouse is from Poland, & the waiting time for outland applications in Poland is approximately 1 year according to CIC's website. To be honest my spouse and I are still unsure of which application package to choose. My Wife is in Canada with me for 5 months on visitors visa at the moment

With the outland application, is it also possible to have an open work permit / visa extension while the application is being processed?

Thanks

You cannot get OWP if you go with outland process. However, it will be possible to apply for visa extension.

Honestly, if you want my opinion, I would choose outland process, because even if it will take Warsaw maximum time to process, i.e.12 months, it is still less that a regular waiting time for inland process. You wife will be able to get OWP only after you will be approved as a sponsor, and if I m not mistaken, the current waiting time for inland sponsor approval are about 12 months itself.
Also, I would like to mention that Warsaw processing real fast right now, especially Poland residents (I am going through the same office). Check Warsaw VO statistics. People get PR 3-4 months after sponsor approval, which means about 6-8 months total.

I'd go with outland. We applied through Warsaw and were done in a total of 9 months.
The posted times for Warsaw went up because they took over the files from Moscow. Some of the files had already been sitting there for a while before being transferred, so the posted times went up, even though they were processed fairly quickly in Warsaw.

Many thanks for the recommendation :) . Do you think I should apply for a visa extension together with the outland application package? Or should I do it after i send out the application? I've read somewhere that it might be of benefit to do your visa extension after sending your application package because they look for a motive/reason when accepting visa extensions.

Any other tips/advice that you can give in regards to doing the outland process through Poland are greatly appreciated

Thanks

Did you have to do an interview by any chance?
