Hi all, I just received the most disheartening news this morning after contacting my potential employer. I have been waiting on a LMO since Nov 21 and the process was being completed by a Agent(Employment Consultant). When I spoke to the employer yesterday they were shocked that the agent did not contact me as they had received confirmation that a LMO had been approved for their company. When I called the employer this morning for some feedback as he was going to call the agent for feedback I was surprised to learn that the agent had been to visit the company with a new applicant and told the employer that I was no longer a client of theirs. Needless to say both the company and I were taken back by this. The LMO received by the company has no names on it and we have no clue as to the next step. The employer still wants to employ me but not sure how to proceed, and I'm left with only three and a half weeks left on my TRV. Can anybody shed some light please.

Oh, I'm so sorry. Although it's great news the LMO was approved.

I don't know how things work with an agent. But if the LMO has no name on it and the employer wants YOU (not this other applicant) can't they just put your name on it? And then you can go to the border and apply for a work permit? I hope it is as simple as that. I would think the employer has a copy of the LMO and not the agent, as they only assist in the process? I don't think it should matter if you are a client of theirs, although I don't really know. Can the employer call Service Canada to find out how to do this?

I really hope someone else can offer some advice to you.

Did you sign a contract with the agent or the company? You can extend your stay (apply thru CPC-Vegreville) and cite waiting for LMO and WP (if the employer is still willing to go thru the process of hiring you).

You should note that although the LMO doesn't have a name on it, it was issued for a specific Foreign employee. Read the following information bulletin: http://www.cic.gc.ca/english/resources/manuals/bulletins/2011/ob310.asp So the LMO could have been issued for you, another person can't use it.

I did not sign a contract with either as the whole process was done telephonically as I'm in BC. I'll call the employer again to suggest the visa extension, what paperwork would I need to submit to the CPC-Vegreville? I'm guessing a copy of the LMO and a letter confirming intent of employment, should I also include previous work permit (from 2009) as prove of experience to do the job? And is the employer able to nominate a applicant on a un-named LMO.

What is your current status in Canada? If you're on a temporary visitor status (TRV-visitor), you can request to extend your stay. Ask the employer if they're willing to go thru the process to hire you (job bank ads, LMO) and to send you a job offer/contract after the mandatory recruitment efforts has been shown and this has to be done ASAP since you have less than a month. Your employer should be very willing to this for you ASAP (should have been done yesterday :( ). Then send the request for extension and make sure that you send a complete package.

Yes your employer can check, there is a two-page annex that is for employer's/rep's only that has the candidate's name. And if it was made in your favour, the agent can't arbitrarily change the employee. They will have to start all over again.

Update,
The agent wants $3000.00 from me to do my application for a work permit. The LMO was approved in principal to the employer. I have let the employer know that I don't have that kind of money, so the ball is in his court. As the employer is not sure whether or not he may proceed without the help of the agent, and not happy that they did not file the application naming me as the intended recipient. Not to sure how this is going to play out. The agent requested my resume be sent to them again as they don't have it on file from last November. Thanks to all who took the time to give me advice and support.

I'm so sorry about this mess, g. That is an insane and ridiculous amount of money to ask of someone! I have also just learned that it is illegal in some provinces for an agent to charge for finding someone a job. If you paid them you may want to look into that at some point.

Could the employer call Service Canada to find out if they can proceed with a work permit for you, without the agent?

I wish I had some good advice for you but I'm sure someone else will have some answers. As always, hoping everything works out for you.

job_seeker is right about the 2-page annex. The employer can request a fax of the LMO from service canada.

I think the agent is trying to make money off you. If you can confirm the LMO was issued to you, you can apply for a work permit on your own. Be sure to take note of this agent's full contact information and make a complaint.

The employer did request it yesterday and confirmed that it was issued without a named nominee. I'd rather not rock the boat as this is my second bite at the cherry so to speak and got burned the last time I worked in Canada.Thank you for the reply Senorita.

Thanx for the PM, I found that very interesting. I'll forward that piece of info to the employer and maybe that will encourage him to move forward and exclude the agent completely. Thanx so much
