Hi Members,
I applied for Sponsorship of my CommonLaw Partner in May 2014.
Then we split for some reason.
I withdrew my application in Feb 2015
CIC accepted my withdrawal in Mar 2015.

BUT after two months we realised that we made mistake in splitting and we are back again.
We reconciled and wants to continue our relationship and get married eventually.

My partner is on Work Permit and it will expire in Jul 2015.
I want to sponsor her and live here with me.
I am Canadian and working for many years here in Toronto.

Please give me advise as to how I can go ahead with the application of sponsorship and OWP.

From what country is your partner and when will you reach 12 months of continuous cohabitation?
 
My partner is Indian Origin.
She came here for Study. She completed her three years study and she has been holding work permit of three years. That will expire in Jul 2015

We were living together from Aug 2012 till Feb 2015.
Two months we were separated.
We now reconciled and wanting to continue our relationship.
 
Because you withdrew your sponsorship, and essentially broke up, I think you will have to live together for one year before you can apply again. So if you started living together in April 2015, you can apply again in April 2016.

Yes, you can get married and apply immediately.
 
Out of curiosity. I presume she holds a post-graduate work permit. Is there a reason she did not already apply to immigrate under CEC (Canadian Experience Class)? She would have needed just 1 year of full-time skilled work experience or part-time equivalent.

Anyway, that option is still available to her(through Express Entry, assuming she qualifies), if sponsorship proves challenging.

That's actually not the only requirement. The job also has to be NOC skill level A, B or 0. If she holds a NOC skill level C or D job, she doesn't qualify for CEC.
 
Hello Members,

Thank you for your input. Below is my clarification:-
We both are not prepared to get married as yet. Her entire family is in India. My family members are here and they have no objection with me relationship. And of course they don’t interfere as well.

She has Canadian Pilot Licence. BUT she could not get Pilot job as she still doesn’t have 3000 hours of flying experience. It is very costly to pay and get flying experience.
However, she has more than one year experience as ‘Weight & Balance Specialist’ with one of the airline managed companies. This job comes under B class skilled category.
- 2272 Air traffic controllers and related occupations
She is trying with her company to get LMO but finding it difficult.

Is there any way she can extend her current work permit for a year or so?

Please let me know your expert opinion.

Only if she's able to obtain an approved LMO/LMIA.

This is something the employer has to do. They have to start by advertising the job for at least 1 month to prove that no Canadian could be found for the role. Then they have to submit the LMIA application for processing along with a $1,000 fee. Processing will likely take 2-4 months. If the LMIA is approved, she can then apply for a work permit. If her work permit expires next month and her company hasn't submitted the LMIA application yet - there's really no chance she's going to have an approved LMIA and be able to submit a new work permit before her current work permit expires. She will have to apply to change her status to visitor before her work permit expires if she wants to remain in Canada (of course she will have to stop working as soon as her current work permit expires).
 
Oh! this process is beyond her control.

BUT, her company should have done this.
As when this position was opened 'Weight & Balance Specialist' as per her knowledge only few applications were received. four gave tests. The result has to be 90% passing only they give this job. Two passed this test. She was one of those two.
If she leaves next month, it will be difficult for her company as this is a round a clock job.
After getting this job, there was further training given by each airline.
Some time back she heard news / rumor that her HR is working on her documentation but is kept confidential. So she is not aware of any such thing.
I hope it was not rumor.

It sounds as if she would quality for Express Entry via the Canadian Experience Class, provided you do not live in the province of Québec. She will need to complete a profile to see how many points she would receive, to estimate her odds of selection. Her odds are greatly improved if her employer can get a LMIA for her position, but even without she may stand a chance -- the previous round of invitation (not the current) went to those with over 453 points.
