Visitor Visa Refused with Australia in Travel History

Applied for visitor visa for me and my wife from New Delhi online. Showed 12 days stay with prepaid flights and hotels and CA 8000 in Bank Accounts in Indian and Foreign.

  • Having Australia in travel history.
  • Having Current Australian Tourist Visa till new year.
  • Children are PR in Australian

Reasons given for rejection.

  • Travel History
  • Family ties in Canada and in country of residence
  • I am not satisfied that you have sufficient funds, including income or assets, to carry out your stated purpose in going to Canada or to maintain yourself while in Canada and to effect your departure.

Any suggestions for applying again ?

3. Did your children apply with you? Are they minors? Unmarried?
3. What documents did you submit?
4. What ties do you and your wife have to India: Employment/business + property ownership + dependent family members + good financial situation (without borrowing), etc
5. Typically, how long did you stay in Australia on your previous visits?

  • They already have visitor visa for USA and Canada for the validity of their passports.
  • One is unmarried and one is married who was mentioned to accompany us in canada.
3. What documents did you submit?
  • Business Registration + CA certificate + Last 3 Years ITRs
  • Bank statements of Indian and Australian accounts + Property Documents
  • Proof of relationship with children and their passports with US- Canada visas
  • Travel History showing Current and Previous Australian visitor Visas having maximum 12 months continuous stay option.

4. What ties do you and your wife have to India: Employment/business + property ownership + dependent family members + good financial situation (without borrowing), etc

  • Have own business operating from more than 30 years,
  • Commercial Property and Commercial vehicles,
  • No dependent family member,
  • Good cash flow but most of the business activities are in cash.

5. Typically, how long did you stay in Australia on your previous visits?
Last visit was 5 month

Unfortunately, it is not surprising why you and your wife were refused.

1. Your previous stay in Australia won't count as Travel History because you stayed for 5 months.... which is a long-length stay, not typical of a regular visitor + it indicates weak employment/weak business ties in India.

2. With no other short travel history to other visa-required countries + your wife/ married child/ other family members wanting to visit Canada together.... your family ties to Canada outweigh those to India = Possibility to overstay your visit.

3. The fact your children have Australian PR is irrelevant to your visa application.

4. You don't have a Canadian host. If you had one (and in the absence of other travel history), it would make your visit to Canada to seem more convincing.

5. You did not include evidence to prove your business is actively trading in India. For example, contracts/purchase orders, company profile, customer list with contact information, audit report/ profit-loss statement, employees hired, salaries paid, rent agreement for the commercial premises, etc etc.

6. A CA statement on its own does not help. It must be supported by copies of actual evidence of financial investments, property ownership documents, movable/immovable assets, etc

7. Hopefully, your bank balance is in line with your income declared in the ITR. Cash deposits/earnings - unless proved with hard facts - are not generally considered as true earnings

8. Not sure if your wife demonstrated any individual reasons to return to India + reasonable finances for her visit and/or financial support from you

That means we can apply for Australian PR because we are eligible but not migrating permanently but not doing so shows we have no intention to leave India.

I have explanation for other points too, anyway what do you think can get it if reapply ?

Future plans/future possibilities are not considered. Canadian immigration authorities assess applications on the here-and-now principle.

Even parents of Canadian PRs must prove they will be short-stay visitors although they have the opportunity to immigrate (that PGP PR is now a lottery-based process doesn't help)


I have explanation for other points too, anyway what do you think can get it if reapply ?
Do re-think your applications based on my feedback + do post the new lists of documents that you intend to submit (separately for yourself and your wife).

Your new applications must answer these questions through hard evidence and explanations:
1. Why Canada especially when you don't have compelling reasons to visit? Why not another country aside of Australia?
2. How can you prove to the visa officer that you have strong reasons + good financials to return to India?
3. Flight tickets and hotel reservations don't help for TRVs. That said, did you or was it your child who paid for these bookings?
