My husband's visitor visa is to expire on October 20, 2014.
We got married while on his visitor visa and sent in the application for me to sponsor him (inland).
My question is do I need to extend his visitor visa again while waiting for them to approve AIP? will he just be on implied status.

He will absolutely need to file for extension. They also prefer you do that a month before it expires. I'd be getting that done ASAP. it will be implied status while you are waiting for approval of the extension. However if you do not apply for an extension you must leave by the expiration date, otherwise the process may get much more complicated...

Hi Elana,

I was in the same situation as your husband's and was advised that once you file for your inland application, you assume implied status. Hence, even in the event that you had applied for your husband's visitor visa extension and it got denied, he would still be in good legal standing due to the implied status.

I am new to this process as well, so hopefully someone more experienced can shed some light on this.

Hope this helped!

This is actually not true. Just sending an inland application for sponsorship will not give you implied status, unless you attached an application for an Open Work Permit along with your application. It is highly unlikely that the application to extend the stay as a visitor would be denied, however. But you still have to extend it and you would still have to restore your status if it expires.

Wow, thank to you and Trav0370 for the clarification. I learn something new everyday on here from experienced people like yourselves. I will keep this is mind when sending out my application. Good luck!

I sent a OWP along with my husband's inland application.
So in other words I still need to extend his visitor visa?
I'm going to try and call CIC call centre and see what they say.

No, you don't need to extend his status. It will be a waste of money. The other poster is wrong.

As long as you sent OWP app with the inland app, he is on IMPLIED status during entire processing time, as long as he stays in Canada.
